Received a call at 2:22 p.m. from Jean Hahn saying that memo <br />concerning bike path dedication could he picked up; picked up copy at <br />approximately 3:30 p,m. <br /> <br />c. Received a call from Debbie Jeffries at approximately 4:00 p.m. sayi~g <br />that Gerry McDonnell [projectatchitect] had discussed proposed bicycle <br />. trail with Ed Smith, fARes Department Director. Ed Smith considered <br />the proposed trail a very poor idea. <br /> <br />d. Debbie Jeffries discussed the proposed trail with <br />member of the Bicycle Committee and was told that the proposed trail <br />was very inapprppriate. <br /> <br />13. July 7) 19.88. <br /> <br />a. Debbie Jeffries met with Diane BiShop on the site and reviewed <br />proposed plan for the golf course. Diane reportedly indicated that she <br />had not realized that fairways extended to the river and that there <br />would be extreme safety problems if a trail was extended through the <br />golf course area. Diane indicated that the proximity of trails was one <br />of the reasons for objection to the proposed Alton Baker COurse. Diane <br />left the site at 10:30 a.m. saying that there were other alternatives for <br />the trail and that she would withdraw the request for dedication across <br />the golf course property. . . <br /> <br />b. Public hearing on combined applications commenced at 1:30 p.m. City <br />reasserted its request for dedication of the biCYCle trail; objections to <br />that request were presented; . record held open for three weeks to allow <br />time to attempt a solution and to allow applicant time to prepare a legal <br />brief on the "taking" issue. The Hearings Official indicated that, even . <br />without the benefit of further legal briefing, he viewed dedication of <br />the biCYCle trail as very probably a taking under the Nolan decision and <br />that City and County staff should approach further discussion with <br />applicants with that iti mind. <br /> <br />Some of problems with proposed trail noted at hearing: (1) lack of <br />correspondence with TransPlan depiction; (2) potential inability to <br />establish linkages on north and south due to active sand and gravel <br />excavation areas; (3) safety and liability; (4) adverse impact on <br />proposed golf course; (5) City saying dedication to be made.to Lane <br />County but no indication that County was prepared to accept dedica- <br />tion; and. (6) taking issue. <br /> <br />,c. After conclUSion of the hearing, Debbie Jeffries asked Diane Bishop <br />what had happened between 10:30 a.m. and 1:30 p.m. to cause her to <br />
