ORD I NANO E No . ~005~ <br />AN ORDINANCE CONCERNING THE CITY STORMWATER SYSTEM ~ AND <br />AMENDING SECTIONS 6.406 AND 6.446 OF THE EUGENE CODE, <br />1971. <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: <br />Section 1. The definition of "City stormwater system" set forth i n Section <br />6.406 of the Eugene Code, 1971, i s amended to provide: <br />6.406 Definitions . For purposes of sections 6.401 through 6.645, unless <br />the context requires otherwise words and phrases shall have the meaning ascribed <br />to them . In interpreting the meaning of words i n a def i ni ti on , ather defi ni ti ans <br />of that word i n this Code may be considered <br />City stor~water,,s~er~. Those stormwater facilities located <br />on city-awned property, city right -of -way, city easements and any <br />stormwater faci 1 i ty the city i s contractually or 1 egal ly obligated <br />to operate and maintain , including but not 1 i mi ted to <br />~a 7 An apes drai nageway, headwater stream, creek, <br />wetland, spring, or pond, including those not maintained by <br />the city which drain onto city-owned property or into city <br />maintained facilities; <br />t b ~ A pi pe or sewer and its related appurtenances that <br />carry stormwater and have been designed and constructed <br />expressly for use by the general public and accepted by the <br />city ; <br />~c7 Streets , curbs and gutters and other surfaces i n <br />the public way which are designed to carry stormwater, <br />roadside drainage ditches along unimproved city streets but <br />not access drive culverts ; and <br />Ordinance - 1 <br />
