<br />(1) The City will not take any action or omit any action ifit would cause the Series <br />2000 Bonds to become "arbitrage bonds" under Section 148 of the Code. <br /> <br />(2) The City shall operate the facilities financed with the Series 2000 Bonds so that the <br />Series 2000 Bonds are "qualified bonds" under Section 141 of the Code and <br />"exempt facility bonds" under Section 142 of the Code. <br /> <br />(3) The City shall pay, when due, all rebates and penalties with respect to the Series <br />2000 Bonds which are required by Section 148(f) of the Code. <br /> <br />(B) The City Official may enter into additional covenants to protect the tax-exempt status of <br />the Series 2000 Bonds. The covenants contained in this Section 13.6 and any covenants <br />in the closing documents for the Series 2000 Bonds shall constitute contracts with the <br />Owners of the Series 2000 Bonds, and shall be enforceable by them. <br /> <br />The foregoing Resolution adopted by the City Council of the City of Eugene, <br />.". <br />Lane County, Oregon on the /1 day of IntVc..t.. 2000. <br /> <br />c(tec~er {J rr T <br /> <br />Page 25 - Resolution <br /> <br />March 23, 2000 <br />
