experienced by City staff following adoption of the Plan respond to a situation not <br />anticipated during Plan adoption and are thus consistent with this criterion. <br />Section 9.145 ~2}~c}3. "Incorporation into the plan of new inventory material which relates <br />to a statewide goal; or" <br />Findings: Proposed amendments which address rare plant protection numbers 62, 67 and 68} <br />are introduced to respond to new information about rare plant distribution that was <br />not available at the time of Plan adoption. Information gathered since adoption of <br />the Plan shows that there are a number of small wetland sites, surrounded by <br />development, with small rare plant populations which would be very difficult to <br />protect due to their isolation from other habitat areas, small size, and surrounding <br />uses. Due to their isolated nature these sites cannot be integrated or connected to the <br />larger wetland system. When the Plan was adopted in 1992, it was thought that the <br />rare plants existed only on the large, pristine wet prairie wetland sites such as the <br />willow Creek Preserve. Amendment #62 would require consideration of plant <br />species listed in the Plan taken from the Gregon Natural Heritage Program Lists 1 <br />and 2}when evaluating new wetland sites for designation. This change is based upon <br />the results of recent plant surveys, which have revealed the distribution of rare plant <br />species on the adopted list. Therefore, these amendments address new inventory <br />information which addresses Statewide Goal 5, and are consistent with this criterion. <br />Conclusions: Amendments 62, 63, 64, 65, 67 and 68 are consistent with this criterion. <br />Section 9.145 ~~}~c} 4. "A change in public policy," <br />Findings: The nine proposed amendments dealing with the mitigation program are based upon <br />changes in how the mitigation bank operations are conducted, which in turn is based <br />upon an intergovernmental agreement which includes the City of Eugene, Oregon <br />Division of State Lands, Gregor Department of Environmental Quality, U.S. <br />Environmental Protection Agency and U. S. Army Corps of Engineers these include <br />proposed policies numbered 73, 74, 75, 76, 77, 78, $2 and 83}. <br />Three proposed policies are needed to maintain consistency with other changes being <br />proposed. These amendments include numbers 66, 80 and S 1. <br />Amendments #66 and #80 reflect changes to the protection and development criteria <br />under amendment #62. Amendment #81 reflects a new policy added under amendment <br />#65. <br />Conclusions: The proposed amendments listed above which address changes in mitigation bank <br />operation reflect new state and federal policy and the local intergovernmental <br />agreement implementing the City's bank program, and thus meet this criterion. <br />Text Amendments Ordinance, Exhibit C (Refinement Plan Amendment Findings) page g <br />
