GRDINANCE NG. 201ZS <br />AN GRDINANCE CALLING A CITY ELECTIGN GN NGVEMBER 3,1995, <br />FGR THE PURFGSE OF REFERRING TG THE LEGAL ELECTURS OF <br />THE CITY OF EUGENE AN GRDINANCE CGNCERNING INSTALLATIGN <br />GF AN AMERICAN FLAG GN SKINNER'S BUTTE; AND DECLARING AN <br />EMERGENCY. <br />The City Council of the City of Eugene finds as follows: <br />A. It would be in the public interest to submit to the legal electors of the City an <br />Ordinance dedicating the property commonly known as the "Butte Propert~r," the boundaries of <br />which are described in a charter amendment adopted by the voters of the City on April 5,19I5, as <br />a memorial to the veterans of all wars in which the United States has participated. <br />B. The Ordinance would further provide that the City maintain an aluminum flag pole <br />on the southeast edge of the crest of Skinner's Butte and prescribe its dimensions, the dimensions <br />of flags to be affixed, and the manner in which flags would be displayed. <br />NGW, THEREFGRE, based upon the above findings, <br />THE CITY GF EUGENE DGES aRDAIN AS FGLLOwS: <br />Section 1. The property commonly known as the "Butte Property," with boundaries as <br />described in a charter amendment adopted by the voters of the City April 5, 1915, is hereby <br />dedicated as a memorial to the veterans of all wars in which the United States has participated. <br />Section 2. On the southeast edge of the crest of Skinner's Butte, the City shall maintain <br />in perpetuity an aluminum. flag polewith anabove-ground height of at least ninety X90} feet on which <br />shall continuously be flown an American flag of not less than 1 o by 19 feet and a larger flag of <br />appropriate dimensions on special holidays and occasions, <br />~a} The flag shall be appropriately illuminated during all periods of darkness and <br />may be lowered on occasians of high winds or other extreme weather conditions. <br />fib} The required flag pole shall be first erected and placed in service not later than <br />five and one half months after this section becomes effective. <br />Section 3. The City Council orders a city election to be held in the City of Eugene, <br />Oregon, concurrently with the general election on the 3rd day of November,199S, in accordance with <br />the provisions of Chapter 254 of the Oregon Revised Statutes, for the purpose of referring to the <br />qualified electors the question of whether Sections 1 and 2 of this Ordinance shall become effective, <br />and the ballots shall be counted and tabulated and the results certified as provided by law. <br />Ordinance -1 <br />
