H, on November 16,1998, the Eugene City Council held a joint public hearing with the Lane County Board of Commissioners and Springfield City Council on the evidentiary record created before the Planning Commissions and is now ready to take action. I. Evidence exists within the record and the findings attached hereto that the ro osal meets . pP the requirements of Chapter 9 of the Eugene Code,197I, and the requirements of the a l~cable state and pP local law. New, THEREFORE, THE CITY OF EUGENE DaES GRDAIN AS FOLLOWS: Section 1. The above findings, and the f ndings set forth in Exhibit C attached hereto and incorporated herein by reference are hereby adopted. Section Z. The Metro Plan Diagram land use designation for the 9.1 acre western portion of the site identified as assessor map 17-04-07-00, tax lot 100, located immediately south of the ai ort is s amended from Airport Reserve to Government and Education, as depicted in Exhibit A attached hereto and incorporated herein by this reference. Section 3. The Airport Master Plan on-Airport Land Use Plan diagram for the 9.1 acre western portion of the site identif ed as assessor map 17-04-07-00, tax lot 100, located immediately south of the airport, is automatically amended from Environmental Buffer to Air Cargo, as depicted in Exhibit B attached hereto and incorporated herein by this reference, in conformance with the provisions of EC 9.1364}. Section 4. Notwithstanding the provisions of the Eugene Charter of 1976 and the Eugene Code, 1971, this Ordinance shall not become effective until identical provisions are adopted by the Lane County Board of Commissioners and Springfield City Council. Section 5. if any section, subsection, sentence, clause, phrase, or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, that portion shall be deemed a separate, distinct, and independent provision and that holding shall not affect the validi of the .. tY rema~ning portions of this ordinance.
