ORDINANCE NO. ~~,~ <br />AN aRDINANCE VACATING THE EAST-WEST ALLEY <br />LaCATED WEST aF ALMADEN STREET. <br />The City Council of the City of Eugene finds that: <br />A. Can the 14~` day of September,1995, the City Council of the City of Eugene by Motion <br />duly passed, called a public hearing to be held at 7:30 p,m., Pacific Time on the 12~' day of October, <br />1995, at the Council Chambers at City Hall, Eugene, Oregon, at which time and place protests and <br />remonstrances could be heard as to the proposed vacation of the following described alley right-of <br />way: <br />The east~west alley, located west of Almaden Street, east of Filmore <br />Street, and north of west Fourth Avenue, Tax Lots 5000, 9000 and <br />13400, Assessor's Map 1704-25-43, as more particularly described <br />in Exhibit A attached hereto. ~A&K Development Nest 3rd Place SV <br />95-oa3}. <br />B. Notice was duly and regularly given of the hearing and at said time and place the <br />Council heard all objections to the proposed vacation and determined that the record for the public <br />hearing remain open until actober 2d, 1995, <br />C. All persons owning property abutting the alley to be vacated have consented to the <br />vacation and applied for the same. Based on testimony at the public hearing and conferences between <br />City staff and the applicant, it appears in the public interest to implement a set of traffic improvements <br />in the vicinity of the area being vacated, including, trafl~c calming improvements, guard rails, bollards <br />and additional signs, City staff, a majority of the affected neighbors, and the applicant have agreed <br />on those traffic improvements, which staff have indicated will be processed pursuant to Chapter 5 of <br />the Eugene Code,1971. <br />QRDINANCE -1 <br />
