D. The City has assessed a total of $37,400 for both the vacation of the above-described <br />alley and the vacation of the public right-of way for VLrest Fourth Avenue, ~A&K Development Sv <br />98-004}, which is the amount that is just and equitable as an assessment of the special benefit <br />conferred, <br />THE CITY ~F EUGENE D(]ES ORDAIN AS F~LLt]wS: <br />Section 1. Based an the above findings, which are hereby adopted, the City Council of the <br />City of Eugene finds that due and regular notice of the hearing was published and posted as by law <br />required, all objections raised at the hearing have been addressed, and the consent of the owners of <br />the abutting property have been duly and regularly filed in the proceedings. The public interest will <br />not be prejudiced by the vacation of the alley right-of way. <br />Section 2. All matters necessary to be done have now been duly and regularly completed and <br />the Council is ready to act upon the proposed vacation. <br />Section 3. The herein above-described alley right-of way is hereby vacated, and the alley <br />right-of way so vacated shall revert pursuant to the statutes of the State of Oregon. <br />Section 4.
