ORDINANCE NO. 20153 <br />AN ORDINANCE VACATING A PUBLIC EASEMENT FOR <br />BIKE PATH PURPOSES ON THE SOUTH SIDE OF RIVER <br />ISLAND ESTATES. <br />The City Council of the City of Eugene finds that: <br />Gn the 15th day of March, 1999, the City Council of the City of Eugene by Motion duly <br />passed, called a public hearing to be held at 7:30 p.m., Pacif c Time on the 26th day of April,1999 <br />at the Council Chambers at City Hall, Eugene, Gregon, at which time and place protests and <br />remonstrances could be heard as to the proposed Council initiated vacation, with the consent of the <br />abutting property owners, of the following described public easement for bike path purposes: <br />The 15-foot wide public bike path easement located on the south side <br />of River Island Estates, a residential development, which is situated <br />between the Willamette River and Goodpasture Island Road, Tax <br />Lots 100 and 1 O 1, Assessor's Map 17-04-24-13, as more particularly <br />described in Exhibit A hereto. City of Eugene: River Island Estates, <br />EV 995}. <br />RETAINING herein the public emergency vehicle access easement <br />across the above described property. <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: <br />Section 1. The City Council of the City of Eugene finds that due and regular notice of the <br />hearing was published and posted as by law required, and no valid objections were made at the <br />heaving or filed. The proposed vacation will not substantially affect the market value of the property <br />abutting the above-described easement and the public interest will not be prejudiced by the vacation <br />of the public easement for bike path purposes. The hearing was held on the 26th day of April,1999, <br />at 5:30 p.m., Pacific Time, at the Council Chambers, City Hall, Eugene, Lane County, Gregon, and <br />all matters necessary to be done in the premises have been duly and regularly completed. <br />
