ORDINANCE NO. 20153 AN ORDINANCE VACATING A PUBLIC EASEMENT FOR BIKE PATH PURPOSES ON THE SOUTH SIDE OF RIVER ISLAND ESTATES. The City Council of the City of Eugene finds that: Gn the 15th day of March, 1999, the City Council of the City of Eugene by Motion duly passed, called a public hearing to be held at 7:30 p.m., Pacif c Time on the 26th day of April,1999 at the Council Chambers at City Hall, Eugene, Gregon, at which time and place protests and remonstrances could be heard as to the proposed Council initiated vacation, with the consent of the abutting property owners, of the following described public easement for bike path purposes: The 15-foot wide public bike path easement located on the south side of River Island Estates, a residential development, which is situated between the Willamette River and Goodpasture Island Road, Tax Lots 100 and 1 O 1, Assessor's Map 17-04-24-13, as more particularly described in Exhibit A hereto. City of Eugene: River Island Estates, EV 995}. RETAINING herein the public emergency vehicle access easement across the above described property. THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. The City Council of the City of Eugene finds that due and regular notice of the hearing was published and posted as by law required, and no valid objections were made at the heaving or filed. The proposed vacation will not substantially affect the market value of the property abutting the above-described easement and the public interest will not be prejudiced by the vacation of the public easement for bike path purposes. The hearing was held on the 26th day of April,1999, at 5:30 p.m., Pacific Time, at the Council Chambers, City Hall, Eugene, Lane County, Gregon, and all matters necessary to be done in the premises have been duly and regularly completed.
