Drdi ~~nce ~- ~I <br />f <br />3, Adjustment of a lot or parcel line by the <br />relocation of a common boundary where an additional parcel <br />or lot is not created and where the existing parcel or lot <br />reduced in size by the adjustment is not in conflict <br />with any applicable law or ordinance, including but not <br />limited to provisions pertaining to minimum area, frontage, <br />average width and required setbacks; <br />4. Di visions of land resulting from foreclosures of <br />recorded contracts for sale of real property; and <br />5. The sale of a lot in a recorded subdivision, even <br />though the 1 at may have been acquired by a single owner with <br />other contiguous lots or properties prior to the sale. <br />Partitioner. An owner commencing proceedings under this <br />chapter to effect a partition of land individually or through an <br />agent. <br />Performance a reement or band. A financial commitment as <br />required by the city and executed by an Oregon licensed surety <br />company in an amount equal to the full cost of construction and <br />improvements as required in this chapter, and conditioned upon the <br />faithful performance thereof. <br />Petition for im rovement. A petition as required by the city <br />and submitted to and approved by the council far construction and <br />improvements as required by this chapter. <br />Plannin director. The director of the planning department <br />of the City of Eugene or hi s~/her designate. <br />Plat. A final diagram, drawing, or replat containing all the <br />descriptions, locations, specifications, dedications, provisions <br />and other information required by this chapter concerning a subdi- <br />vision, <br />Private access a reement. A recorded legal document in <br />which one property owner irrevocably grants to the owners of one <br />or mare neighboring lets or parcels, and their successors in <br />interest, a city appproved right to pass over his or her property <br />to gain access to a public or approved private street. <br />Recreational vehicle, A vacation trailer or other unit with <br />ar without motor power that ~1} is identified as a recreational <br />vehicle by the manufacturer, ~2} bears a state recreational <br />vehicle insignia, ~3} i s designed for human occupancy, ~4} i s to <br />be used temporarily far recreational purposes, and ~5} has a floor <br />area of less than 2~4 square feet including bathrooms and built-in <br />equipment such as wardrobes, closets, cabinets, and kitchen units. <br />Repair garage. A building used for the care and repair of <br />motor vehicles, including major and minor work such as body and <br />fender work or engine and transmission overhaul, and incidental <br />storage or parking of vehicles. <br />Rescue mission. Anon-profit agency providing food, temporary <br />housing, clothing and other support services primarily far adult, <br />transitory individuals. <br />Road ar street, A public or private way, other than a public <br />alley, that is created to provide ingress or egress far vehicular <br />traffic to ane or more lots, parcels, areas or tracts of land, <br />excluding a private way that is created to provide ingress or <br />egress to land in conjunction with the use of land for forestry, <br />
