It is consistent with the purpose and intent of the <br />Land Division Ordi nance~. <br />2. The existing lot is occupied by a duplex that con- <br />forms to all applicable regulations. <br />3. A single family structure wi11 not replace or be <br />added to the lot. <br />4. The existing lot contains at least $,ODD square feet. <br />5. The resulting lots will be relatively equal in size <br />with the maximum difference equal to ten percent or less of <br />the total area of the original lot. <br />5. Average lot width is at least 45 feet. <br />7. Minimum lot area is at least 3,50D feet. <br />$. Each parcel will have independent service unless <br />common service is approved by the affected utility agency <br />and is adequately covered by a city attorney approved ease- <br />ment recorded in the Lane County Recorder's office and estab- <br />lishing the rights, responsibilities, and liabilities of the <br />affected parties. <br />9. Prior to approval, the planning director may require <br />an applicants} to enter into a written, city attorney <br />approved agreement suitable for recording in the Lane County <br />Recorder's office that establishes rights, responsibilities, <br />and liabilities with respect to maintenance and use of common <br />areas such as, but not limited to, roofing, water pipes, <br />and wiring. <br />~f} Lot and Parcel Side Lines. As far as is practicable, <br />lot and parcel side lines shall run at right angles to the street <br />upon which the lots or parcels face, except that on curved streets <br />they sha11 be radial to the curve. <br />fig} Suitability for Intended Use.
