Not later than 30 days after the date of submission of a petition, <br />the city manager shall take action on the petition. <br />~8} Factual Basis for Rule, Unless otherwise provided by ordi- <br />nance, the adoption, amendment, or repeal of a rule by the city manager need <br />not be based upon or supported by an evidentiary record. <br />~9} validity of Rules. Al] rules shall be adopted in substantial <br />compliance with the provisions of this section in effect on the date the <br />rule is adopted. <br />3.015 Business Licenses - Administrative Powers of the City Mana er ar <br />Desi nee. <br />~1} The city manager shall have the authority to approve rules <br />concerning the administration and enforcement of this chapter, The rules <br />may address, but are not limited to: <br />~a} Application fees required with each business license <br />application calculated to reimburse the cost of processing the <br />application; <br />fib} The procedures to be followed and information to be <br />required regarding an application fora new ar renewed license; <br />~c} The procedure to be used in reviewing applications for <br />all new and renewal licenses; <br />~d} A requirement for the provision of bonds and/or insur- <br />ance, and the amounts and types thereof; <br />fie} The procedure far monitoring the performance of or ser- <br />vices provided by licensees. <br />~~} The city manager or designee shall have the authority to: <br />~a} Administer oaths; <br />fib} Audit records to assure conformance with this chapter; <br />~c} Certify official acts; <br />~d} subpoena and require attendance of witnesses at meetings <br />or hearings to determine compliance with this chapter; <br />fie} Require production of relevant documents; <br />~f} Swear witnesses; <br />fig} Take testimony of any person by deposition; and <br />~h} Perform all other acts necessary to administer or <br />enforce the provisions of this chapter. <br />3.0 Z 0 Business _ L ~ c e n s,e s - Ap„p ,,, ~ ,.,._,,... ~ ,,.~ s e . <br />1 i ca~t~ on far L~ cen <br />~1} An application fora business license, or for renewal of a <br />business license required by this chapter shall be accompanied by an appli- <br />cation fee in the amount set by rule adopted under this chapter. The appli- <br />cation fee is not refundable. <br />~~} An applicant shall make a request fora business license on <br />forms provided by the city and shall include all requested information and <br />attachments. Review of an application shall not begin until all requested <br />information has been provided. <br />~3} then reviewing the application, the city may require the <br />applicant to supply information necessary to determine under section 3.050 <br />the applicant's qualifications for the license, <br />~4} The city shall issue a decision on the application within 30 <br />days of the submission of a complete application form and all requested <br />attachments. <br />Ordinance - 18 <br />
