The Grantee shall pay all reasonable expenses incurred by the Grantor in defending itself with regard to all dam- ages and penalties mentioned in Subsection ~3} above. The insurance policies mentioned above sha11 contain an endorsement stating that the poli- cies are extended to caner the liability assumed by the Grantee under the terms of this ordinance and shall contain the following endorsement; ~t is hereby understood and agreed that this policy may not be cancelled nor the amount of coverage thereof reduced until 30 days after receipt by the Finance Director of the City of Eugene by registered mai 1 of a written notice of such intent to cancel or reduce the coverage. (6~ Evidence of Insurance Filed with Grantor. A11 policies of in~ surance or certified copies thereof and written evidence of payment of re- quired premiums shall be filed and maintained with the Grantor during the term of the franchise. ~7~ Na Waiver of Performance Bond. Neither the provisions of this franchise nor any insurance accepted by the Grantor pursuant hereto, nor any damages recovered by the Grantor thereunder, shall be construed to excuse faithful performance by the Grantee or limit the liability of Grantee under the franchise for damages, either to the full amount of the bond ar otherwise.
