10/14/85.) <br />Section 14. Solicitation by Grantee . Grantee may solicit subscribers <br />for any of Grantee`s services through house-ta-house or place-ta-place solici- <br />tation without the necessity of obtaining a license, permit, or other form of <br />approval from the Grantor, provided Grantee shall maintain an up-to-date list <br />of solicitors on file with the commission and local law enforcement agencies. <br />Section 15. Resol uti.on a.f Disputes, <br />~~} intent. 1t is the intent of the Grantor to provide for orderly <br />resolution of disputes arising out of the enforcement or interpretation of <br />provisions of this franchise, or any rule, regui ati on, or procedure relating <br />to cable communications matters. To this end, the procedures set forth in <br />Subparagraphs (2) and (3) below may be implemented upon the election of either <br />the Grantee or Grantor where agreement has not been reached after a reasonable <br />time and goad faith negotiation. ~n addition, any controversy or dispute may <br />be submitted to binding arbitration as set forth i n Subparagraph ~ 4~ below, <br />but only upon agreement of both Grantee and Grantor. As further incentive to <br />use these informal procedures for resolution of disputes, the fees and expen- <br />ses of fact-finding, mediation, and arbitration sunless otherwise determined <br />by the arbitration panel} shall be borne equally by the Grantee and Grantor, <br />but the costs and expenses of any court action arising from a dispute be- <br />tween Grantor and Grantee shall be borne by the nonprevailing party, pursu- <br />ant to Section 18 herein. Amended by Grdinance No. 19359, 1G/14/85.) <br />~2} Fact-Findin Any controversy or dispute, upon the election <br />of either the Grantee or Grantor, shall be submitted to an expert individual <br />acceptable to bath parties for an investigation of the facts and a report <br />thereof. Such fact-finding shall be for the purpose of developing better <br />information for the use of both parties and shall not be binding on either <br />party. <br />Grdinance - ~5 <br />
