7.166 Local Improvements -Hearing an Improvement, <br />1 Before award of a local improvement construction contract, <br />the counci 1 or its designee shall hot d a publ i c hearing on the improvement, <br />At the hearing the city engineer shall pravi de: <br />~ a} An estimate of the unit cost to be assessed to prvperti es <br />i n the improvement district. <br />fib} An estimate of the city costs that the improvement would <br />entail, <br />~ c} A recommendation on whether the improvement should be <br />made, <br />When the hearing is conducted by the council's designee, the designee shall <br />prepare a written summary of the hearing and submit it to the council, <br />~~} When the hearing required by subsection 7,1661} is conducted <br />by the council's designee, if the owners of property that would bear more <br />than hat f the amount estimated to be assessed to finance the improvement or <br />repair of a street or alley remonstrate, the council's designee shall Con- <br />ti nue the hearing to a counci 1 meeting and direct the city engineer to send <br />by f7 rst-class mai 1 a noti ce to the owners of the affected property stating <br />the date, time and place of the counci 1 meeting when the proposed improve-~ <br />rent and the remonstrance wi 11 be considered, <br />~3} After considering evidence and argument presented at the hear- <br />ing, the council may; <br />~ a} Subject to city charter 1 i mi tati ons, approve the 1 ocal <br />improvement with or without minor modifications and order i t to be <br />made, <br />~ b } Delay the approval not more than 15 days, <br />~c} Substantially modify the improvement and call for new <br />bids thereon, <br />~d} Abandon the improvement. <br />~4} If the council orders a local improvement to be made and does <br />not cancurrentl y 1 evy the assessments therefor, notice of the prospective <br />assessments to finance the improvement shall be given to each ti t1 a company <br />known to the finance officer to be conducting business i n the city, Each <br />company that receives the notice shall record the prospective assessment in <br />al 1 title searches for property i n the assessment district contemplated for <br />the improvement. <br />7.170 Local Improvements -Assessments -Computation. For a local im- <br />provement or ere y t e counci the tots estimated cost or the <br />total cost of the improvement shall be computed by the city engineer and <br />shal 1 i nc1 ude but not be 1 i mi ted to the costs of constructing the improve- <br />ment, engineering, interest on warrants, advertising, and providing notice <br />of assessments and overhead. The city engineer shall apportion the tots] <br />estimated cost or the total cost of the improvement i n accordance with sec- <br />tion 7,115, <br />7.175 Local Improvements -Apportionment of Assessments, <br />W atever s are o t e tota est~ mate or actual project costs <br />of the local improvement i s to be borne by the city shat 1 be deducted from <br />the total project costs before they are apportioned and assessed under thi s <br />section. The city shall pay the casts of the fal 1 owi ng, provided funds are <br />avai 1 abl a and the project has appropriate priority <br />Ordinance - 22 <br />
