6, DD7 Nuisances -~ Prahi bi ti on and Responsi bi 1 i ty to Abate .
<br />o person response e s a cause ar permit a nuisance on
<br />public or private property,
<br />~~} The person responsible shall be liable far injury, damage or
<br />1 oss to person or property caused by the negligent fai 1 ure to abate any nui s-
<br />ance described in this code.
<br />~ 3 } The city shat 1 not be 1 i abl a for injury, damage or 1 oss to any
<br />person ar property caused i n whole or i n part by the fai 1 ure of the person
<br />responsible to comply with subsection ~ 1 } of this section, or by the fai 1 ure
<br />of the city as a person responsible to abate a nui sance.
<br />~ 4 } Neither the duty of the person responsible to keep property
<br />free of nuisances nor hislher failure to da so is dependent upon notice from
<br />the city to abate the nui sance,
<br />~5} The person responsible shall defend and hold harmless the
<br />city from all claims for loss or damage arising from the fai 1 ure to compl y
<br />with subsection ~ 1 } of this section.
<br />G,41D Nuisances Affecting the Public. The following are nuisances which
<br />may a abate as provided ~n this code:
<br />~ a } Ani mat carcasses, etc, The deposi ti an of an ani mat
<br />carcass or part t ereo , or any excrement or sewage, or industrial
<br />waste, or any putrid, nauseous, decaying, deleterious, offensive,
<br />or dangerous substance in a stream, well, spring, brook, ditch,
<br />pond, river, or other inland waters within the city, or the
<br />placing of such substances i n such position that high water or
<br />natural seepage will carry the same into such waters.
<br />fib} Attractive nuisances. No owner or person in charge
<br />of property sha11 perrni t thereon:
<br />1. Unguarded machinery, equipment, or other devices
<br />which are attractive, dangerous, and accessible to children.
<br />~. Lumber, logs, or pilings placed or stared in a
<br />manner so as to be attractive, dangerous, and accessible to
<br />children,
<br />3. An open pit, quarry, cistern, or other excavation
<br />without safeguards or barriers to prevent such places from
<br />being used by children.
<br />4. An open, vacant structure which is attractive, dan-
<br />gerous and accessible to children or which is used for habi~-
<br />tati on by trespassers,
<br />This section shat 1 not apply to authorized construction
<br />projects with reasonable safeguards to prevent injury or death to
<br />playing children,
<br />~c} Debris, An accumulation of decomposed animal or vege-~
<br />table matter, garbage, rubbish, manure, offal, ashes, discarded
<br />containers, waste, paper, debris, trash, May, grass, straw, weeds,
<br />litter, rags, or other refuse matter or substance which by itself
<br />or i n conjunction with other substances i s deleterious to publ i c
<br />health or comfort, or i s unsi ghtly, or creates an offensive odor.
<br />~d} Fences,
<br />1. A fence, barrier, partition or abstructi an el ectri -
<br />cally charged or connected with any electric source in such a
<br />manner as to transmit an e1 ectri cal shock or charge to any
<br />person, ani mat or thing which might come i n contact therewith.
