The council shall <br />have ful power and authority to abandon and rescind proceedings <br />for ~ mprovements made under sects ons 7.465 to 7.565 at any time prior to the <br />final completion of the improvements. If liens have been assessed on real <br />property under the procedure, they shall be cancelled, and payments made an <br />the assessments shall be refunded to the owner~s~ of the property at the <br />time the council abandons or rescinds the proceedings. <br />7,555 Off-Street Parking - Oura tive Provisions. No improvement assess- <br />ment s a be ren ere ~ nval ~ d by reason of a fai 1 ure of the city <br />manager's report to contain al 1 of the information required by section 7.465 <br />or by reason of a fai 1 ure to have al 1 of the information required to be i n <br />the improvement ordinance, the assessment ordinance, the lien docket or <br />notices required to be published and mailed, nor by the failure to list the <br />Warne of, or mai 1 nati ce to, the record owner of real property as required by <br />sections 7.465 to 7.565, or by reason of any other error, mistake, delay, <br />omission, irregularity, or other act, jurisdictional or atherwi se, i n any of <br />the proceedings or steps specified, unless it appears that the assessment is <br />unfair or unjust in its effect upon the person complaining. The council <br />shall have the power and authority to remedy and correct al 1 matters by sui t- <br />able action and proceedings, <br />1,560 Off-Street Parking -~ Reassessment. ~Ihenever an assessment, <br />de ~c~t assessment or reassessment for an improvement which has <br />been made by the city has been, or shall be, set aside, annulled, declared <br />or rendered void, or its enforcement restrained by a court of competent jur- <br />i sdi cti on, or when the counci 1 shat 1 be i n doubt as to the validity of the <br />assessment, deficit assessment, or reassessment, or a part thereof, then the <br />council may make a reassessment in the manner provided by the laws of the <br />state, provided, however, that the counci 1 or its designee may conduct any <br />hearings as provided in sections 7.480 and 7.500. <br />Ordinance - 50 <br />
