4, Either: <br />a. improvements as required by this code or as a <br />condition of tentative plan approval have been completed; <br />or <br />b, A performance agreement bond} or suitable sub- <br />sti tote as agreed upon by the city and appl ~ cant has <br />been filed with the finance officer in a sufficient <br />amount to assure the completion of all required improve- <br />ments; or <br />c, A petition for improvements has been properly <br />executed by the applicant who i s seeking the partition <br />and will be assessed for the improvements. <br />5, Public assessments, 1 i ens, and fees with respect to <br />the minor partition have been paid, or a segregation of assess- <br />ments and liens has been applied for and granted by the city <br />counci 1 or the city finance officer, or an adequate guarantee <br />has been provided assuring the taxes, liens, assessments and <br />fees wi 11 be paid prior to recordation. <br />Section 4. Subsection ~4 ~ ~ a~ of Section 9.035 of the Eugene Code, 1971, <br />is amended to read and provide: <br />9.035 Mayor Partition and Subdivision Tentative Plan Procedure, <br />~4} Tentative Plan -~ Planning Director Decision, <br />a Un ess the appl ~ cant agrees to a l onger time period, the <br />planning director shall approve, conditionally approve, or deny a <br />tentative plan application with findings and conclusions thereon, <br />within 30 days of receipt of a compl ete and accurate application , <br />The planning director ` s decision shal 1 be based on the fol 1 owl ng <br />criteria : <br />1, Approval does not impede the future best use of the <br />remainder of the property under the same ownership or adver- <br />sely affect the safe and healthful development of the remai n- <br />der or any adjoining land or access thereto, <br />2. The proposed development will be consistent with <br />applicable adopted neighborhood refinement plans, special <br />area studies, and functional plans, <br />3, The proposed development will not cause unreasonable <br />street congestion, risk of fire, flood, geol ogi ca] hazards, <br />pal 1 uti on, or similar dangers, hamper adequate provision for <br />transportation, .water supply, sewage disposal , drainage, edu- <br />cat~on, recreation, and other public services and facilities, <br />or result in inadequate light and air or overcrowding of land, <br />Section 5.
