ORDINANCE NO, 1 <br />AN ORDINANCE AUTHORIZING THE INSTITUTION OF <br />PROCEEDINGS IN EMINENT DOMAIN FOR THE ACQUISI- <br />TION BY CONDEMNATION OF PROPERTY INTERESTS <br />FOR THE CONSTRUCTION OF A PEDESTRIAN AND <br />BICYCLE PATH ALONG AMAZON CHANNEL ~RICHARDSON <br />BRIDGE TO WEST OF BAILEY HILL RDAD~ AND FOR <br />CLARIFICATION OF CITY'S RIGHT TO MAINTAIN THE <br />AMAZON DRAINAGE CHANNEL; AND DECLARING AN <br />EMERGENCY. <br />The City Council of the City of Eugene finds that: <br />The City Council has authority under provisions of the Cit <br />Y <br />Charter and applicable state law to institute proceedings in <br />eminent domain for the acquisition by condemnation of rivate <br />P <br />property for public purposes, including the construction and <br />maintenance of pedestrian and bicycle pathways and of storm drain- <br />age facilities. <br />When the Amazon Water Control District of Lane County ~Dis- <br />trio} was dissolved, the City of Eugene received all of the <br />District assets and assumed all of its liabilities, The Di~trirt <br />assets included the right to construct and maintain the then <br />constructed Amazon Drainage Channel. <br />Since receiving the District's assets, the City of Eu ene has <br />g <br />from time to time performed maintenance activity tv reserve the <br />P <br />capacity of the Amazon Drainage Channel. <br />The existing public records for certain properties are un- <br />clear in defining the extent of the easements held by the Cit of <br />Y <br />Eugene as District's successor to construct and maintain the <br />Amazon Drainage Channel. <br />The construction of the pedestrian and bicycle path along the <br />ordinance - 1 <br />
