Amazon Drainage Channel between Richardson Bridge and West of <br />Bailey Hill Raad approximately 375 feet and the clarification of <br />the easements to maintain the Amazon Drainage Channel between <br />Richardson Bridge and West of Bailey Hill Rvad approximately 580 <br />feet necessitates the acquisition by the City of certain property <br />rights in the parcels of real property described on the attached <br />exhibits, which in the City's judgment constitutes the most bene- <br />ficial and practical location for the construction, and the best <br />method of establishing a public record of the City's right to <br />enter upon property to maintain the existing Drainage Channel. <br />The proposed improvements are in compliance with and in <br />furtherance of the plans and specifications prepared by the City <br />Engineer at the Council's direction and in accordance with rovi-~ <br />p <br />sions of the Eugene Cade, 1971 and applicable policies and a ree- <br />g <br />ments of the City of Eugene. <br />The efficiency of dealing with property owners once in estab- <br />lishing the pedestrian and bicycle path and at the same time <br />clarifying the maintenance easements of the City, plus the costs <br />of delaying the project, and the need to incrementally extend the <br />Fern Ridge bike/pedestrian path as funds are available, requires <br />the City to act promptly to acquire the property interests for <br />this project . Now, therefore , <br />THE CITY of EUGENE DOES ORDAIN AS FOLLOWS: <br />Section 1. Based upon the above findings, which are incor-~ <br />porated herein by reference and hereby adopted, the City Council <br />of the City of Eugene does hereby find, declare, and determine it <br />necessary to acquire certain ownership in fee interests, permanent <br />ordinance - 2 <br />
