ORDINANCE NO. 19494 <br />AN ORDINANCE REGARDING THE SETTING OF MUNICIPAL FEES; <br />AMENDING SECTION 2.020 OF THE EUGENE CODE, 1971; AND <br />DECLARING AN EMERGENCY. <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOI~S: <br />Section 1. Section 2.020 of the Eugene Code, 1971, is amended to read <br />and provide: <br />2,020 Cit Mana er - Authorit to Set Fees and Char es. <br />~1} Except as this code provides to the contrary, the cet mana er <br />shall determine and set all y g <br />fees imposed by the city for services, goads, use <br />of municipal property, licenses and permits. As used herein, "cit mana er" <br />means the cit mana er yr h' y g <br />y g is/her designee. <br />~2} In determining the amount of any such fee the city mana er <br />shall consider: g <br />~a} Applicable policies, enactments and directives of the <br />counc~ l ; <br />fib} The amount charged by the city in the past; <br />~c} The full costs of providing the service supported b <br />the feeā¢ y <br />~d} The amounts charged by other comparable providers; <br />and, <br />fie} The revenue needs of the city as determined by the <br />adopted city budget. <br />~3} At least 30 days prior to the initiation of anew fee or <br />change in the amount of such a fee, the city manager shall eve notice of <br />the ro osed fee b : g <br />p p y <br />~a} Making copies of a notice of intended charges available <br />to the mayor and city council. <br />fib} Making copies of a notice of intended charges available <br />to any persons who have requested such notice; <br />~c} Publishing a notice of intended charges in a news a er <br />of eneral ci rcul ate ~ p ~ p <br />g, on w~th~n the city ~f the fee or charge ~s or <br />7s 1~kely to be $250.00 or greater; and, <br />~d} Posting such notice at two locations at city ha11. <br />~4} The notice shall state the current and proposed fee, and the <br />time, place and manner in which interested persons may present written com- <br />ments an the proposed fee. Defective notice shall not be grounds for invali- <br />dating any fee ar charge. <br />~5} After considering any written comments, the city mana er shall <br />set the fee b administrate g <br />y ve order. All such administrative orders shall be <br />compiled and retained at the city recorder's office. Copies of an adminis- <br />trative order settin ~ ~ ~ ~ y <br />g or changing a general fee which ~s or ~s likely to be <br />$250.00 ar greater shall be provided to the mayor and cit council. <br />y <br />Section 2.
