Goal6-Air,WaterandLandResourcesQuality:Tomaintainandimprovethequalityoftheair, <br />water,andlandresourcesofthestate. <br />Goal6addresseswasteandprocessdischargesfromdevelopment,andisaimedatprotectingair, <br />waterandlandfromimpactsfromthosedischarges.Theproposedregulationsareakeyaspect <br />oftheCitysresponsetofederalCleanWaterActregulations,specificallytheUpperWillamette <br />BasinTotalMaximumDailyLoad(TMDL).SeveralwaterwaysinEugenedonotstatewater <br />qualitystandardsforcertainpollutants.Forthesewaterways,thestateofOregonDepartmentof <br />EnvironmentalQuality,thestateagencychargewithimplementingTMDLregulations,has <br />developedtheUpperWillametteTMDLtobringthesewaterwaysbackintocompliancewith <br />statestandards.TheUpperWillametteTMDLallocatespollutantloadstodesignated <br />managementagencies,includingtheCityofEugenethathavetheauthoritytoimplementwater <br />qualityimprovementswithintheirjurisdictionalboundaries.Onemanagementstrategy <br />identifiedintheUpperWillametteTMDLforaddressingmultiplepollutantsistheapplicationof <br />streamsidebuffers. <br />Therefore,theordinanceisconsistentwithStatewidePlanningGoal6. <br />Goal7-AreasSubjecttoNaturalDisastersandHazards:Toprotectlifeandpropertyfrom <br />naturaldisastersandhazards. <br />Goal7requiresthatlocalgovernmentplanningprogramsincludeprovisionstoprotectpeople <br />andpropertyfromnaturalhazardssuchaslandslides.Thisordinancedoesnotdirectlyaddress <br />potentialnaturaldisastersandhazards.Thesehazardsareaddressedbyseparatestudiesand <br />protectionmeasures.However,the/WQoverlayzoneprohibitsconstructionwithinspecified <br />setbacksoftheidentifiedwaterways.Assuch,theoverlayzoneprovidesbenefitswithrelation <br />tofloodimpactstorealpropertyandthuscouldprovidefurtherprotectionsconsistentwith <br />StatewidePlanningGoal7. <br />Goal8-RecreationalNeeds:Tosatisfytherecreationalneedsofthecitizensofthestateand <br />visitorsand,whereappropriate,toprovideforthesitingofnecessaryrecreationalfacilities <br />includingdestinationresorts. <br />Goal8ensuresprovisionofrecreationfacilitiestoOregoncitizensandisprimarilyconcerned <br />withtheprovisionofthosefacilitiesinnon-urbanareasofthestate.Theproposedordinance <br />willnotimpactprovisionofrecreationalfacilities,norwillitaffectaccesstoexistingorfuture <br />recreationalfacilities.Therefore,theordinanceisconsistentwithGoal8. <br />Goal9-EconomicDevelopment:Toprovideadequateopportunitiesthroughoutthestatefora <br />varietyofeconomicactivitiesvitaltothehealth,welfare,andprosperityofOregonscitizens. <br />Theordinancewillnotimpactthesupplyofindustrialorcommerciallands.Therefore,the <br />amendmentsareconsistentwithGoal9.The/WQoverlayzonedoesnotrenderaproperty <br />unusableforcommercialorindustrialuses.Infact,specificprovisionsinthe/WQoverlayzone <br />ensurethattheoverlayzonedoesnothavesuchaneffectonaproperty.Someofthose <br />provisionsare: <br />UpdatedDraftLegislativeFindings-forCouncilMeetingMarch9,2009 <br />Page4of17 <br />
