1.Theuserestrictionsofthe/WQoverlayzoneonlyapplytothatportionofalot,orright-of- <br />wayarea,thatiswithinthechannelofanidentified/WQwaterwayandthespecifiedsetback <br />distancefromthewaterwaybasedontheassociatedsetbackmeasurementpoint.Theuse- <br />restrictedareaisreferredtoasthe/WQsetbackmanagementarea.Withintheportionsofthe <br />lotthatareoutsideofthe/WQmanagementarea,landusesarenotrestrictedbythe/WQoverlay <br />zone.EC9.4780(1).Propertiesthathaveabasezoninganddesignationallowingcommercialor <br />industrialusescanstillbedevelopedwithsuchusesonthoseportionsofthelotthatarenot <br />withinthe/WQmanagementarea. <br />2.Iftheregulatedareaoccupiesmorethan33%ofadevelopmentsitearea,uponapplicationof <br />thepropertyowner,andconsistentwiththeothercriteriaofEC9.8030(25)(a),theCitywill <br />reducethesizeofthe/WQconservationareatoensurethattheareaconstitutesnomorethan <br />33%ofthedevelopmentsitearea. <br />3.Uponapplicationoftheownerofalotwiththe/WQoverlaythatshowsconsistencywiththe <br />criteriaofEC9.8030(25)(b),thecitywillreducethesizeofthesetbackdistance. <br />4.Uponapplicationoftheownerofalotwiththe/WQoverlaythatshowsconsistencywiththe <br />criteriaofEC9.8030(25)(c),thecitywillallowusesnototherwiseidentifiedintheordinance,or <br />approveadifferentmeansofprotectingwaterqualitytoallowaproposeddevelopmentthat <br />wouldnotbepermissibleunderthestrictapplicationoftheordinance. <br />Consideringtheseprovisionsofthe/WQoverlayzone,theapplicationoftheoverlayzonetoa <br />propertyzonedanddesignatedforcommercialorindustrialusedoesnotresultinanunlawful <br />diminutionintheareassupplyofcommercialorindustrialland. <br />Evensupposingtheprovisionsabovewerenotapartoftheoverlaysregulations,theoverlayis <br />beingappliedtosuchasmallnumberofacresincludedintheareasinventoriesofcommercial <br />andindustriallandsthatthisordinanceoverlaycouldnotdiminishtheareassupplyofthose <br />landsbelowtheprojectedneed. <br />AnanalysisofpotentialimpactstothesupplyofbuildablecommerciallandswithintheEugene <br />citylimitsandUGBwasconductedusingtheregionalGeographicInformationSystem(GIS) <br />andcalculationsofsupplyanddemandfromtheEugeneCommercialLandsStudy,1992.The <br />State-acknowledgedEugeneCommercialLandsStudyincludedasurplusofCommercialacreage <br />of170acres.Thisacreagerepresentsthoselandsthatweredesignatedascommerciallands, <br />beyondtheacreageneededtoaccommodatetheprojected20-yeardemand.Sincetheadoption <br />ofthatStudy,theCityhastakenvariousactionsthroughDecember2008thathavehadanet <br />decreaseintheamountofsurpluscommercialacreage,resultinginacurrentsurplusof94.29 <br />acres.Eveniftheprovisionsdescribedin1.-4.,above,werenotincludedintheordinance,the <br />/WQregulationscontainedinthisordinancecouldaffect,atmost,1.30acresofcommercially <br />designatedlandalllocatedwithinthecurrentcitylimits,leavingasurplusof92.99acres. <br />AnanalysisofpotentialimpactstothesupplyofbuildableindustriallandswithintheEugene <br />UGBwasconductedusingtheregionalGeographicInformationSystem(GIS),dataprovidedby <br />UpdatedDraftLegislativeFindings-forCouncilMeetingMarch9,2009 <br />Page5of17 <br />
