Goal15-WillametteRiverGreenway:Toprotect,conserve,enhanceandmaintainthenatural, <br />scenic,historical,agricultural,economicandrecreationalqualitiesoflandsalongthe <br />WillametteRiverastheWillametteRiverGreenway. <br />TheWillametteGreenwayareawithintheEugeneUrbanGrowthBoundaryandcitylimitsis <br />governedbyexistinglocalprovisionswhichhavebeenacknowledgedascomplyingwithGoal <br />15.Thoseprovisionsareunchangedbythisordinance.Theproposaldoesnotaffectanyarea <br />withintheWillametteGreenwayBoundaryand,evenifitdid,theproposedprovisionswould <br />servetofurtherimplementthisgoalbyprovidingwaterqualitysetbackprotectionsalong <br />affectedwaterways. <br />Goal16through19(EstuarineResources,CoastalShorelands,BeachesandDunes,andOcean <br />Resources): <br />Therearenocoastal,ocean,estuarine,orbeachandduneresourcesrelatedtotheproperty <br />affectedbythisordinance.Therefore,thesegoalsarenotrelevantandtheordinancewillnot <br />affectcompliancewithGoals16through19. <br />(2)IsconsistentwithapplicableprovisionsoftheMetroPlanandapplicableadopted <br />refinementplans. <br />TheproposedcodeaddsregulationstotheLandUseCodewiththeintentofprotectingthose <br />waterwaysthathaveasignificantrelationshiptowaterwaysidentifiedbythestateDepartmentof <br />EnvironmentalQualityasnotmeetingwaterqualitystandardsbutthatarenototherwise <br />regulatedinawaythatprotectswaterquality.Theproposed/WQWaterQualityOverlayZone <br />designatesaregulatedwaterqualitymanagementareawhichiscomprisedofthewaterway <br />channelanditsapplicablesetback.Theproposedsetbackdistance,appliedtobothsidesofthe <br />regulatedwaterway,iseither25feetmeasuredfromthetopofhighbankforatributarytoa <br />waterqualitylimitedstreamor40feetmeasuredfromcenterlineforaheadwaterstream. <br />METROPLANPOLICIES <br />. <br />Theabovedescribed/WQoverlayregulationsareconsistentwiththefollowingMetroPlan <br />Policies: <br />C.EnvironmentalResourcesElement <br />Air,WaterandLandResourcesQuality(Goal6) <br />C.25 Springfield,LaneCounty,andEugeneshallconsiderdownstreamimpactswhen <br />planningforurbanization,floodcontrol,urbanstormrunoff,recreation,andwater <br />qualityalongtheWillametteandMcKenzieRivers. <br />Theoverlayzonerestrictsdevelopmentactivitiesandotheruseswithinandadjacentto <br />certainwaterwaystoprotectthequalityofstormwaterrunoffandwaterqualityin <br />receivingwaterwaysincludingtheWillametteRiver. <br />UpdatedDraftLegislativeFindings-forCouncilMeetingMarch9,2009 <br />Page9of17 <br />
