Basedontheforgoingdiscussionandanalysis,itisclearthatevenifthemaximumpossiblearea <br />withintheproposed/WQmanagementareawastreatedasasubtractionfromtheresidential <br />buildablelandsinventory,andtakingintoaccountplanamendmentsthattooklandoutof <br />residentialcategories,andtakingintoaccountpreviouslegislativezonechanges,therewouldstill <br />2 <br />beanetsurplusofbuildablelandsintheapplicablecategoriesforresidentialland. <br />Therefore,theordinanceisconsistentwithGoal10. <br />Goal11-PublicFacilitiesandServices:Toplananddevelopatimely,orderlyandefficient <br />arrangementofpublicfacilitiesandservicestoserveasaframeworkforurbanandrural <br />development. <br />Theareaaffectedbythisordinanceislocatedinsidethecitylimitsandisservedbythepublic <br />facilitiesinwhichtheexistinglevelofserviceisadequatetoservetheneedsofexistingand <br />futuredevelopment.Theprovisionsofthisordinancedonotaffecttheplanningordevelopment <br />offuturepublicfacilitiesorservices.Therefore,theordinanceisconsistentwithGoal11. <br />Goal12-Transportation:Toprovideandencourageasafe,convenientandeconomic <br />transportationsystem. <br />Goal12isimplementedthroughtheTransportationPlanningRule(TPR),asdefinedinOregon <br />AdministrativeRuleOAR660-012-0000,etseq.TheEugene-SpringfieldMetropolitanArea <br />TransportationPlan(TransPlan)providestheregionalpolicyframeworkthroughwhichtheTPR <br />isimplementedatthelocallevel.TheTPR(OAR660-012-0060)statesthatwhenlanduse <br />changes,includingamendmentstoacknowledgedcomprehensiveplans,significantlyaffectan <br />existingorplannedtransportationfacilitythelocalgovernmentshallputinplacemeasuresto <br />assurethattheallowedlandusesareconsistentwiththeidentifiedfunction,capacityand <br />performancestandards(levelofservice,volumetocapacityratio,etc.)ofthefacility. <br />Adoptionoftheordinancewillnotsignificantlyaffectanexistingorplannedtransportation <br />facility.Therefore,Goal12isnotimplicatedbythisordinance. <br />Goal13-EnergyConservation:Toconserveenergy. <br />Thisordinancedoesnotconcernenergyconservation.Therefore,Goal13doesnotapply. <br />Goal14-Urbanization:Toprovideforanorderlyandefficienttransitionfromruraltourban <br />landuse. <br />Thisordinancedoesnoteffectthetransitionfromruraltourbanlanduse.Itappliesonlyto <br />propertyalreadywithintheCitylimits.Therefore,Goal14doesnotapplytothisordinance. <br />2 <br />TheCitysadoptionofthe/WQregulationsdonotimpactlandoutsideoftheCitylimits.IfLaneCountychooses <br />toadoptsimilarprovisions,itwillassessitsimpactatthattime.Thelandidentifiedtoreceivethe/WQoverlayzone <br />uponannexationincludes25.99acresofbuildableresidentialland.However,itisnotclearwhen,ifevertheseacres <br />willbeannexedor,whether,whentheydoannex,theywillqualifyforanexemptionundertheordinance.Evenif <br />theseparcelsareconsideredasdebitstotheexistingsurplus,theordinanceisconsistentwithGoal10. <br />UpdatedDraftLegislativeFindings-forCouncilMeetingMarch9,2009 <br />Page8of17 <br />
