REFINEMENTPLANPOLICIES <br />Theabovedescribed/WQoverlayregulationsareconsistentwiththefollowingRefinementPlan <br />Policies: <br />ComprehensiveStormwaterManagementPlanPolicies <br />1.1 Incorporatethebeneficialfunctions(floodcontrol,stormwaterconveyance,water <br />qualitytreatment)ofnaturalresourcesintotheCitysstormdrainagesystem. <br />Establishmentofa/WQoverlayzoneprotectscertainwaterwaysthathaveimportant <br />waterqualityfunctionalbenefitsandarevulnerabletoimpactfromdevelopmentusesand <br />activities.Theoverlayzoneprotectionssignifytheimportanceofthesewaterwaystothe <br />Citysstormdrainagesystem. <br />1.2 Maintainfloodcontrol,drainage,andwaterqualitytreatmentcapacitiesalong <br />theCitysstormwaterconveyancecorridorswhileprotectingandenhancingthehealth, <br />diversityandcontinuityforwildlifehabitat,nativevegetation,andendangeredspecies. <br />Theoverlayzoneincludesprovisionstoprotectthewaterqualitytreatmentcapacitiesof <br />certainwaterways,whileatthesametimemaintainingthefloodcontrolandconveyance <br />functions,andprotectingandenhancingnativevegetation. <br />1.4 Amendexistingregulationsandadministrativepoliciesandpracticestobe <br />consistentwiththegoalsandpoliciesoftheStormwaterPlan. <br />TheproposalamendstheEugeneCodetoadda/WQWaterQualityOverlayZone,in <br />fulfillmentofStormwaterPlanpolicies. <br />1.5 Developnewdesignstandardsandmaintenancepracticesthatmeetthemultiple <br />objectivesoftheStormwaterPlan. <br />Theoverlayzoneincludesspecificcriteriaanddevelopmentstandardsforcertainallowed <br />useswithinthe/WQmanagementareawhichmeetthemultipleobjectivesofthe <br />StormwaterPlan. <br />2.1 Meetorexceedfederalfloodhazardrequirements. <br />Theoverlayzoneincludesprovisionsthatenablemaintenanceofstormdrainagechannels <br />inaccordancewithapplicablefederalguidelines,regulations,andmaintenance <br />agreements. <br />3.1 Meetorexceedfederalandstatestormwaterqualityrequirementsespecially <br />wheretheyconformwithexistinglocalpolicy. <br />The/WQoverlayzoneprotectswaterwayswhichareidentifiedbythestateofOregon <br />DepartmentofEnvironmentalQualityaswaterqualityimpaired(onthestates303(d) <br />List),waterwaysthatdraindirectlyintoawaterqualityimpairedwaterway,and <br />UpdatedDraftLegislativeFindings-forCouncilMeetingMarch9,2009 <br />Page12of17 <br />
