headwatertributariesthatareparticularlysensitivetoerosiveeffectsofincreased <br />stormwaterrunofffromnewdevelopmentandthatdrainintoawaterqualityimpaired <br />waterwayAND-whicharenototherwiseprotectedbyexistingregulations.TheUpper <br />WillametteTotalMaximumDailyLoadliststheCityofEugeneasaDesignated <br />ManagementAgency,responsiblefordevelopingandimplementingaplantoachieve <br />waterqualityimprovementgoalsforwaterqualityimpairedwaterwaysincluding <br />AmazonCreek,A3Channel,AmazonDiversionChannel,WillowCreekandthe <br />WillametteRiver.Theoverlayzonemeetsfederalandstatestormwaterquality <br />requirementsandconformswithexistingStormwaterPlanpolicies. <br />3.3 Reducestormwaterpollutionassociatedwithnewconstructionanddevelopment, <br />soilerosion,improperuseofstormwaterfacilities,andcityoperationsandmaintenance <br />practices. <br />The/WQoverlayzoneprotectscertainwaterwaysfromadversewaterqualityimpacts <br />fromdevelopmentusesandactivitiesthatcouldbeharmfultowaterqualityincluding <br />newconstruction,vegetationremoval,soildisturbance,andoperationsandmaintenance <br />practices.Theoverlayzoneincludesprovisionstomitigateforthewaterqualityimpact <br />ofcertainusesandactivitiesforwhichthereisnootheralternative. <br />4.1 Maintainthestormwatersystemthroughtechniquesandpracticesthatbalance <br />floodcontrol,drainageservices,waterquality,andnaturalresourceprotectionneeds. <br />The/WQoverlayzoneinsuresthatchannelmaintenancepracticesareprotectiveofthe <br />waterqualityfunctionofspecificallyidentifiedwaterways. <br />6.1 Encourageandsupportcommunication,coordinationandcooperativeeffortsthat <br />maximizeavailableresources,reduceduplicationofservices,andpreventmanagement <br />conflict. <br />TheCitycollaboratedwithOregonDepartmentofTransportation,LaneCountyand <br />EugeneWater&ElectricBoardstaffduringthedevelopmentofthisproposaltoobtain <br />theirinput.The/WQoverlayzoneprovisionsincludeallowancesforroutinechannel <br />maintenancethatdonotadverselyimpactwaterquality.Theoverlayzoneincludes <br />provisionstomitigateforthewaterqualityimpactofcertainusesandactivitiesforwhich <br />thereisnootheralternative. <br />BethelDaneboRefinementPlan(asamended,January13,2003)Policies <br />II-D1.TheRoyalAvenueSpecificPlanshallserveasthebasisfordevelopment <br />regulationsandinfrastructureimprovementswithintheRoyalAvenueSpecificPlanarea. <br />AmendmentstolanduseregulationsfortheRoyalAvenueNodeshallbeconsistentwith <br />theLandUseElementoftheRoyalAvenueSpecificPlan. <br />The/WQoverlayzonewillnotbeappliedtoanypropertieswithintheRoyalSpecial <br />AreaZone.TheRoyalAvenueSpecificPlanincludesprovisionsfortheprotectionand <br />utilizationofdrainagechannelsformultiplefunctionsincludingwaterqualityprotection. <br />UpdatedDraftLegislativeFindings-forCouncilMeetingMarch9,2009 <br />Page13of17 <br />
