The/WQoverlayzonedoesnotapplyprotectionstoroadsideditchesunlessthose <br />waterwayshaveasignificantrelationshiptowaterwaysidentifiedbythestateDepartment <br />ofEnvironmentalQualityasnotmeetingwaterqualitystandards,arenototherwise <br />protected,andprovideadrainagefunctionforalargerareabeyondtheroadway.Based <br />upontheweightoftheotherMetroPlanandrefinementplanpoliciesinsupportofthe <br />/WQoverlayzone,andgiventheearlydateofthispolicy(1987),the/WQoverlayzone <br />isnotinconsistentwithPolicy2. <br />Policy3.Asannexationorincorporationoccurs,acomprehensivedrainageplanforthe <br />areashallbedevelopedincooperationwithLaneCountyandotherappropriate <br />agencies. <br />3.b.Identifythoseportionsoftheopenstormdrainagewayswhichcanbe <br />retainedandthosewhichshouldbeeliminatedandprovidesufficientright-of-way <br />oreasementsfortheircontinuedmaintenance. <br />The/WQoverlayzoneappliesprotectionstospecificwaterwaysidentifiedduetotheir <br />significantrelationshiptowaterwaysonthestateDEQslistasnotmeetingwaterquality <br />standards,thatcurrentlyprovidewaterqualityfunctions,andthatareotherwise <br />unprotectedfromtheimpactofcertainusesandactivitiesdetrimentaltowaterquality. <br />Theproposalidentifiesthewaterwaysthatshouldberetainedasopenstorm <br />drainageways. <br />Policy6.Intheeventofincorporationorannexation,theresponsiblegeneralpurpose <br />governmentshall: <br />a.Adoptordinanceprohibitingdumpinginopendrainagechannels. <br />Theordinanceidentified(ExhibitC)specifictaxlotsoutsidethecitylimitsandinsidethe <br />urbangrowthboundarytowhichthe/WQoverlayzonewouldbeappliedupon <br />annexation,ifandwhenthepropertiesannextothecityofEugene. <br />SouthHillsStudyRecommendations <br />D(DevelopmentStandards)II(SpecificRecommendations)9.Thatalldevelopments <br />(plannedunitdevelopmentsorsubdivisions)inthesouthhillsareabereviewedtoinsure <br />maximumpreservationofexistingvegetation. <br />The/WQoverlayzoneincludesprovisionsthatlimittheremovalofexistingvegetation <br />andrequireplantingofanybaresoilresultingfromallowedvegetationremoval. <br />WestEugeneWetlandPlanPolicies <br />The/WQoverlayzonedoesnotapplytoanypropertieswithintheWestEugeneWetland <br />PlanBoundary.TheWestEugeneWetlandsPlanoutlinesmechanismsforbalancing <br />wetlandprotectionwithurbandevelopment.ThePlancallsfortheprotectionofover <br />1,000acresofwetlandsthroughamultipleobjectivesstrategyaddressingfloodcontrol, <br />drainageservices,waterqualitytreatment,andnaturalresources.Itaddressestheissueof <br />UpdatedDraftLegislativeFindings-forCouncilMeetingMarch9,2009 <br />Page15of17 <br />
