stormwaterandsupportstheuseofmanagementapproachesthatincorporatenatural <br />systemsforwaterqualityandotherbeneficialuses. <br />WillakenzieAreaPolicies <br />PublicFacilitiesandServicesElement,StormDrainageFacilities <br />1.Encouragedevelopmentpracticesthatreducetheneedforconstructionofan <br />extensivesubsurfacestormsewersystem. <br />Theordinanceregulatesspecificwaterwaysdeterminedtobeimportanttowaterquality <br />andnototherwiseprotected,thusensuringtheircontinuedfunctioninanopencondition <br />asanimportantpartofthecitysstormwatersystem. <br />2.Encouragegrowthanddevelopmentpatternsthatarecompatiblewithnatural <br />featuresanddiscouragethealterationofnaturalfeatures.Relocationofnatural <br />drainagefeaturesmaybeconsideredasanalternativetoreplacementwithaclosedpipe <br />system. <br />The/WQoveralyzoneregulatescertainwaterwaysincludinglimitingalterationstothe <br />waterways.Theordinanceincludesprovisionsthatallowchannelrelocationand <br />reconfigurationundercertaincircumstances,andwithwaterqualitymitigation <br />requirements. <br />3.Encouragemeasuresthatwillimprovethequalityofstormwaterrunoffdischarged <br />intolocalwaterways. <br />The/WQoverlayzoneprotectsexistingwaterqualityfunctionsofcertainwaterways. <br />Theordinanceisacomplimenttoexistingadoptedstormwaterdevelopmentstandards <br />whichrequireon-sitepollutionreductionandflowcontrolmeasures. <br />(3)Inthecaseofestablishmentofaspecialareazone,isconsistentwithEC9.3020 <br />CriteriaforEstablishmentofanSSpecialAreaZone. <br />Theamendmentsdonotestablishaspecialareazone. <br />ApplicationoftheOverlayZone <br />EugeneCodeSectionEC9.8856requiresthatthefollowing <br />criteria(inboldanditalic)beappliedtoaproposaltorezoneproperties: <br />(1)TheproposedchangeisconsistentwithapplicableprovisionsoftheMetroPlan.The <br />writtentextoftheMetroPlanshalltakeprecedenceovertheMetroPlandiagramwhere <br />apparentconflictsorinconsistenciesexist. <br />Seeabove. <br />(2)Theproposedzonechangeisconsistentwithapplicableadoptedrefinementplans.In <br />theeventofinconsistenciesbetweentheseplansandtheMetroPlan,theMetroPlancontrols. <br />UpdatedDraftLegislativeFindings-forCouncilMeetingMarch9,2009 <br />Page16of17 <br />
