Subsection ~ 2 } of Section 7.4 2 3 of the Eugene Code, <br />1971, is hereby. amended to read and provide; <br />7.02 3 Charges -~ Add ustments . <br />~2} The city manager or the manager's designee shall <br />investigate the application and certify to the Eugene Water & <br />Electric Board a reduction, if any, in the applicant's monthly <br />sewer user charges and the conditions and duration of the re- <br />duction. If it is determined that the applicant has paid <br />excessive sewer user charges resulting from conditions beyond <br />the applicant's control, a credit for the excess paid during all <br />or part of the 12 months preceding the application may also be <br />allowed. The full cost of investigating the application auth- <br />orized by this section and any conditions required by the city <br />manager or the manager's designee shall be borne by the appli- <br />cant. The city manager's decision regarding an application <br />shall be final. <br />Section 3. There is hereby added to the Eugene Code, 1971, a <br />new section, to be numbered and provide; <br />7.045 Charges - Cost of Collection. The Eugene Water & Elec- <br />tric Board may withhold from payments directed by sec- <br />tion 7.025 of this chapter a reasonable fee for its actual costs <br />of billing, collecting and remitting sewer user charges. The <br />fee shall be based on actual costs and established annually by <br />agreement between the city manager and EWEB. <br />Section 4. That the matters contained herein concern the public <br />welfare and safety and therefore, an emergency is hereby declared to <br />exist, and in order to provide for the orderly implementation of the <br />provisions hereof, the rates established herein, and the other provi- <br />sions amended or added to the Eugene Code, 1971 shall become effec- <br />tive March 1, 1983. <br />Passed by the City Council this <br />l6 th day of February, 19 8 3 <br />City Recorder <br />Approved by the Mayor this <br />day of Febru ry, 1983 <br />`~ ~ <br />Mayor <br />Ordinance ~ 2. <br />
