<br />made on a form prescribed by the Airport Manager. <br /> <br />9.2 Permit Fee. The application shall be accompanied by a fee set by <br />the Airport Manager under Sections 2.440 to 2.442 of the Eugene Code, 1971. <br /> <br />9.3 Review of Application. An application shall be allowed or denied <br />within 45 days after receipt of a complete application. The application may <br />be approved if: <br /> <br />9.3.1 The requested operation is consistent with the Airport <br />Master Plan, the Eugene-Springfield Metropolitan Area General Plan, and <br />relevant provisions of federal, state and local laws and rules. <br /> <br />9.3.2 The requested operation would enhance the health, welfare <br />and safety of users of the Airport. <br /> <br />In reviewing an application the Airport Manager may consider whether: <br /> <br />9.3.3 The applicant's past or present violation of laws or <br />regulations presents a reasonable doubt about the applicant's ability <br />to conduct activities at the Airport without endangering property or the <br />public's health or safety; <br /> <br />9.3.4 The applicant possesses insufficient skill or expertise <br />to conduct the desired activity; <br /> <br />9.3.5 Allowance of the application will require the expenditure <br />of public funds in connection with the proposed operation; <br /> <br />9.3.6 There is no appropriate, adequate, or available space or <br />building on the Airport to accommodate the entire activity of the <br />applicant at the time of application; <br /> <br />9.3.7 Development or use of the area requested by the applicant <br />will unduly interfere physically with existing operations at the Airport; <br /> <br />9.3.8 The applicant has supplied the City with false information <br />or has misrepresented a material fact in the application; <br /> <br />9.3.9 The applicant has defaulted in the performance of any <br />lease, permit or other agreement with the City; <br /> <br />9.3.10 The applicant does not appear to have, or have access to <br />the finances necessary to conduct the proposed operation for a minimum <br />period of six months; <br /> <br />9.3.11 The applicant has a history of not paying debts when due; <br /> <br />or, <br /> <br />9.3.12 The applicant is unwilling to execute a permit or lease in <br />the form and containing the provisions required by the City. <br /> <br />Nothing contained herein shall be construed to prohibit the City from grant- <br /> <br />Administrative Order - 2 <br />
