DRDZNANCL ND. 19162 <br />AN ORDINANCE CONCERNING DISORDERLY CONDUCT; <br />AMENDING SECTIQN 4.725 DF THE EUGENE CODE, 1971; <br />AND DECLARING AN EMERGENCY. <br />THE CITY DF EUGENE DDE5 DRDAZN AS FDLLDws: <br />Section 1. Section 4.725 of the Eugene Code, 1971, is hereby <br />amended to read and provide: <br />4.?25 Disorderly Conduct. <br />~l} No person shall engage in disorderly conduct. <br />~2} A person commits the offense of disorderly conduct <br />if, with intent to cause public inconvenience, annoyance or <br />alarm, or recklessly creating a risk thereof, that person: <br />Qa} Engages in fighting or in violent, tumultu- <br />ous and threatening physical behavior which creates an <br />unreasonable risk of harm to person or property, or <br />serious public inconvenience or alarm; or, <br />fib} Directs to another person in hearing or in <br />view of a public place words or gestures which when <br />directed to the ordinary citizen are as a matter of <br />common knowledge likely to provoke a violent reaction, <br />and which do provoke a.n the recipient consideration of <br />a violent reaction; or, <br />~c} Congregates with other persons in a public <br />place: <br />1. So as to obstruct a public passage, or <br />2. In dangerous proximity to afire or <br />other hazard, <br />and fails to comply with the lawful order of the police <br />to disperse; or <br />~d} Interferes with a police officer in the off i-- <br />cer's lawful performance of his or her duties. To <br />interfere with as used in this subsection shall mean <br />any physical act, including a refusal to leave a par- <br />ticular area in response to a lawful order from a <br />police officer, that prevents or could reasonably be <br />expected to prevent' a police officer from performing <br />his or her duties; or <br />~.e} Creates or maintains a physically offensive <br />or hazardous condition by any act which serves no legi- <br />timate purpose of the actor, thereby disrupting a group <br />of persons; or, <br />~.f} Spits on, in ar against any surface, sub- <br />stance or person in a public placer or <br />fig} Urinates or defecates in, or in view of, a <br />public place, except in a lavatory; or, <br />Ordinance -~ 1 <br />
