ORDINANCE N0. ~~_ <br />AN ORDINANCE CONCERNING PO~,ICE SERVICE DOGS; <br />AMENDING SECTIONS 4.355 AND 4.874 aF THE EUGENE <br />CODE, 1971; ADDING A NEw SECTION 4.455 To THAT <br />CODE; AND DECLARING AN EMERGENCY. <br />THE CITY OF EUGENE DOES ORDAIN Aa FOI~EOwS: <br />Sectian 1. The first paragraph of Section 4.355 of the Eugene <br />Code, 1971 is hereby amended, and a new definition for "Police ser- <br />vice dag" is hereby added in alphabetical order therein, to read and <br />provide <br />4.355 Animal Control - Definitions. For purposes of sections <br />4.355 to 4.455 of this chapter, the fallowing words and <br />phrases shall mean: <br />Police service dog. A dog used in police work <br />under the control of a peace officer as defined in aRS <br />161.015, whether or not the dog is being so used at <br />the time in question. Unless specifically referred to <br />therein, neither a police service dog or its handler <br />are subject to any of the restrictions or regulations <br />contained in sections 4.355 to 4.455 of this chapter. <br />Section 2. Anew section 4.455 is hereby added to the Eugene <br />Code, 1971, to read and provide; <br />4.455 Interference with a Po~.ice Service Dog. <br />~1} Na person shall intentionally, knowingly, or reck- <br />lessly kill, injure, torment, kick, strike, stone, interfere <br />with, or tamper with a police ser~rice dog while the dog is be- <br />ing caged, kenneled, transported, exhibited, exercised, or <br />engaged in discharging or attempting to discharge any lawful <br />duty or function. <br />~Z} No person sha~,l cause or direct any animal to <br />attack or otherwise interfere with a police service dog while <br />the dog is being caged, kenneled, transported, exhibited, exer- <br />cised, or engaged in discharging or attempting to discharge any <br />lawful duty or function. <br />~3} A police officer may destroy an animal attacking <br />a police service dog if no lesser means are reasonably avail- <br />able to prevent injury to the police service dog. <br />Section 3. Section 4.874 of the Eugene Code, 1971, is hereby <br />amended to read and provide: <br />Ordinance - 1 <br />
