/9~ q~ <br />9.144 Ex iration~ Unless actual construction or alteration has begun <br />within one year, a variance approval terminates. However, prior <br />to expiration, the applicant may request and the building official may <br />extend approval far six month periods. The building official shall never <br />extend approval for more than two years from the first effective approval <br />date. <br />9.746 Com fiance with Substitute Plan and Conditions of A royal. <br />Tf a vari once i s granted subject to certain conditions, or a sub- <br />stitute plan, compliance with the conditions or the substitute plan is re- <br />quired. Departure from approval conditions or the substitute plan is a <br />violation of this ordinance. <br />Section 22. Section 9.834,.9.832, 9.534, and 9.836 are hereby added to <br />the Eugene Code, 197T, to read and provide: <br />Amendment Procedures <br />9.830 A lication of Sections. Amendments to the provisions in the Eugene <br />5ign Cade, Land Division Ordinance, Annexation Procedures, and zoning <br />Ordinance shall be made as provided in sections 9.832 to 9.535. <br />9.$32 Tnitiation. An amendment to the provisions of the 5ign Cade, Land <br />Division Ordinance, Annexation Procedures, or Zoning Ordinance may be <br />initiated by the planning commission or city council as a request to the cam~- <br />mission that it consider a proposed amendment. <br />9.534 Notice, Plannin Commission Public Hearin ,and Decision. <br />~1} The planning commission shall conduct a public hearing on the pro <br />posed amendment. At least 30 days prior to the hearing, the planning depart- <br />ment shall mail notice of the hearing to interest groups and public agencies <br />it has determined, with the advice of the Citizen Tnvolvement Committee, <br />might have an interest in the proposed amendment. At least ten days prior <br />to the hearing, the planning department shall publish a notice thereof in <br />a local newspaper of general circulation in the city. <br />~2~ Following the public hearing, the commission shall decide if the <br />proposed amendment, in its original or modified form, is consistent with <br />adopted plans, policies, and standards. Accordingly, the commission shall <br />forward its recommendation to the council for adoption of the amendment or <br />to withdraw it from further consideration. <br />9.836 Notice, City Council Public Hearin ,and Decision. <br />~1} The council shall conduct a public hearing to consider the com- <br />mission's recommendation. At least ten days prior to the hearing, the <br />planning department shall mail notice of the hearing to parties of record <br />and to interest groups and agencies notified of the commission hearing. <br />~2~ Following the public hearing, the council shall consider the <br />planning commission's recommendation. The council may, by ordinance, <br />adopt the amendment in its original or modified form. <br />Ordinance -4T- <br />
