to the applicant and parties who have requested~a copy on the date ~~/ <br />~~ <br />~t ~s rendered, <br />~d~ Except as provided for variances to this ordinance, <br />approval does not relieve the applicant from other applicable <br />provisions of this code or state law. <br />. ~e~ When it appears to the planning director that the area is <br />to be ultimately divided into four or more lots or parcels, he or <br />. she may require subdivision processing and approval. <br />~4} Dwnershi Verification of Dedications. ~f approval is condi- <br />tioned on the dedication of a portion of the area to the public, the a li- <br />cant shall submit to the lanai ~ ~ ~ pp <br />p ng department a current preliminary tale re- <br />port issued by ~a t~tie insurance company licensed in Oregon verifying owner- <br />ship by the applicant of the real property that is to be dedicated to the <br />public. <br />~5} Acknowled in Decisions. Minor partition approvals shall <br />be effective on the eleventh day after rendered, unless appealed, and shall <br />be noted an the partition map with the effective date of the approval. <br />~6} Return of A roved Minor Partitions. Unless appealed, the <br />the planning department shall return a copy of the approved minor artitian <br />p <br />map and approval documents to the applicant and shall provide two copies <br />thereof to the public works department. <br />~7} A eal of Minor Partition Decisions. <br />~a~ Within ten days of the planning director's decision, it <br />may be appealed to the hearings official by the applicant or an <br />adversely affected.per,son. <br />fib} An appeal shall be on a planning department farm, shall <br />be based on the record, and shall state specifically haw the <br />planning director failed to properly evaluate the proposal or make <br />a decision consistent with applicable criteria, <br />~c} Unless the applicant and appellant agree to a longer <br />. period, the hearings official shall hold a hearing far oral argu- <br />ments on an appeal within ~5 days of its receipt, The hearings <br />official, in his or her discretion, may allow the introduction of <br />additional evidence at that hearing. At least ten days prior to <br />the hearing, the planning department shall mail notice thereof to <br />the applicant, appellant, and persons who requested notice of the <br />planning director's decision, <br />~d} Within ten days of the hearing, unless the applicant and <br />appellant agree to a longer period, the hearings official shall <br />make a decision and mail a copy thereof to the applicant, appellant, <br />and parties who have requested a copy. The hearings's official's <br />decision is final. <br />~S} Recordation. Approved minor partitions shall be recorded <br />~n the office of the Lane County Recorder before the city issues a buildin <br />permit for construction on newl cre g <br />y ated parcels. <br />~9~ Ex iration of Minor Partition A royal. Zf the minor artition <br />is not recorded and a royal co p <br />pp editions fullfilled within one year, the <br />approval expires, Anew application must be submitted far reconsideration. <br />9.035 Major Partition and Subdivision Tentative Plan Procedure, <br />~1} Tentative Plan - A lication.
