<br />ADMINISTRATIVE ORDER NO. 58-98-10-F <br />of the <br />City Manager Pro Tern of the City of Eugene <br /> <br />AMENDING MWMC PROVISIONS OF <br />SYSTEMS DEVELOPMENT CHARGE METHODOLOGY <br /> <br />The City Manager Pro Tern of the City of Eugene finds as follows: <br /> <br />A. Sections 2.020 and 7.705 of the Eugene, Code, 1971 authorize the City Manager of the City <br />of Eugene to determine and set fees and charges to be imposed by the City for services, goods, use of <br />municipal property, and licenses and permits, and specifically systems development charges. Section 7.710 <br />of the Eugene Code, 1971 further authorizes the City Manager to adopt and/or amend by administrative order, <br />the methodologies used for establishing the systems development charges, and provides this may be effected <br />concurrent with the establishment or revision of a systems development charge. <br /> <br />B. In accordance with the procedures set forth therein, on May 27, 1998, I notified the Mayor <br />and City Councilors that I intended to amend the Systems Development Charge Methodology relating to the <br />Metropolitan Wastewater Management Commission (MWMC) by increasing fees for the Regional Wastewater <br />Systems Development charge, eliminating the shopping center category from the rate table as this type of <br />establishment is more accurately described by other categories in the table, and updating the MWMC credit <br />table. MWMC has completed an annual update of the value of its assets, the value of proposed future <br />improvements, and the value of prior property tax payment contributions for existing vacant land. These <br />changes are the basis for the proposed increase in the MWMC SDC rates. <br /> <br />C. The Notice was also posted in four public places within the City and published in the Register <br />Guard, a newspaper of general circulation within the City on May 27, 1998 and June 8, 1998. The Notice <br />provided that written comments could be submitted thereon for a period of 30 days from the date of posting <br />and publication. No comments were received within the time or in the manner required by the Notice. <br /> <br />D. I fmd that the revisions to the Systems Development Charge Methodology and the fees as set <br />forth in Exhibit A (Table I-page 3, Table 5- page D-9, Attachment 3-page D-l 0, Attachment 4-page D-ll, <br />Calculations-page G-4, and Section 2.3-page G-6) hereto are consistent with adopted policies and ordinances <br />of the City, in conformity with applicable state law, and should be implemented effective July 1, 1998. Those <br />portions of the Systems Development Charge Methodologies adopted by Administrative Order No. 58-97-02- <br />F-2 and Administrative Order No. 58-97-07-F, in conflict herewith should be amended as of that effective <br />date. <br /> <br />On the basis of these findings, I order that: <br /> <br />1. The MWMC provisions of the Systems Development Charge Methodology, the MWMC <br />Credit Table, and the rate table are hereby amended as set forth in Exhibit A, including the attachments <br />thereto, which are attached hereto and incorporated herein by reference effective July 1, 1998. <br /> <br />2. Those portions of the Systems Development Charge Methodologies adopted by Administrative <br />Order No. 58-97-02-F-2 and Administrative Order No. 58-97-07-F, in conflict herewith are hereby amended <br />as of July 1, 1998. <br /> <br />Dated this 29th day of June, 1998. ~ <br /> <br />t#~ ~ames R.
