ORDINANCE NO,~ AN ORDINANCE CONCERNING CONDUCT; AMENDING SECTIONS 4.725 AND 4.994 OF THE EUGENE CODE, I97I; ADDING SECTIONS 4.770 AND 4,945 TO THAT CODE; AND DECLARING AN EMERGENCY. THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section I. Subsection ~2} of Section 4.725 of the Eugene Code, I97I, is hereby amended by deleting subparagraphs (d) and (g) therefrom and re- lettering subparagraphs (e), (f), (h), and (i). 4.725 Disorderly Conduct. ~I} No person shall engage in disorderly conduct. d ~ 2} ~-~ person commits the offense of disorderly conduct i f , with intent to cause public inconvenience, annoyance or alarm, or recklessly creating a risk thereaf, that person: ~a} Engages i n fighting or i n vi of ent~, tumultuous and threatening physical behavior which creates an unreasonable risk of harm to person or property, or serious public inconvenience or alarm; or, ~- .. fib} Directs to another person in hearing or in view of a public place words or gestures which when directed to the ordinary citizen are as a matter of common knowledge likely to provoke a violent reaction, and which do provoke in the recipient considera- ti on of a violent reaction; or, ~c} Congregates with other persons in a public place: I. So as tv obstruct a public passage, or ~, In dangerous proximity to afire or other hazard, and fads to comply with the lawful order of the police to disperse; or, ~d} Creates or maintains a physically offensive or hazardous condition by any act which serves no legitimate purpose of the actor, thereby disrupting a group of persons; or fie} Spits on, in or against any surface, substance or person in a public place; or ~f} Jumps or dives from any parking structure, bridge, via- duct, overpass, walkway or other elevated structure; or fig} Throws or drops any object or material from any parking structure, bridge, viaduct, overpass, walkway or other elevated structure. ~3} For purposes of this section "public place" means premises which by function, custom, usage, notice or lack thereof, their physical nature or other circumstances at the time, would cause a reasonable person to believe that permission to enter or remain is not required.
