ORDINANCE NO,~ <br />AN ORDINANCE CONCERNING CONDUCT; AMENDING SECTIONS 4.725 <br />AND 4.994 OF THE EUGENE CODE, I97I; ADDING SECTIONS <br />4.770 AND 4,945 TO THAT CODE; AND DECLARING AN EMERGENCY. <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: <br />Section I. Subsection ~2} of Section 4.725 of the Eugene Code, I97I, <br />is hereby amended by deleting subparagraphs (d) and (g) therefrom and re- <br />lettering subparagraphs (e), (f), (h), and (i). <br />4.725 Disorderly Conduct. <br />~I} No person shall engage in disorderly conduct. d <br />~ 2} ~-~ person commits the offense of disorderly conduct i f , with <br />intent to cause public inconvenience, annoyance or alarm, or recklessly <br />creating a risk thereaf, that person: <br />~a} Engages i n fighting or i n vi of ent~, tumultuous and <br />threatening physical behavior which creates an unreasonable risk of <br />harm to person or property, or serious public inconvenience or <br />alarm; or, ~- .. <br />fib} Directs to another person in hearing or in view of a <br />public place words or gestures which when directed to the ordinary <br />citizen are as a matter of common knowledge likely to provoke a <br />violent reaction, and which do provoke in the recipient considera- <br />ti on of a violent reaction; or, <br />~c} Congregates with other persons in a public place: <br />I. So as tv obstruct a public passage, or <br />~, In dangerous proximity to afire or other hazard, <br />and fads to comply with the lawful order of the police to disperse; <br />or, <br />~d} Creates or maintains a physically offensive or hazardous <br />condition by any act which serves no legitimate purpose of the <br />actor, thereby disrupting a group of persons; or <br />fie} Spits on, in or against any surface, substance or person <br />in a public place; or <br />~f} Jumps or dives from any parking structure, bridge, via- <br />duct, overpass, walkway or other elevated structure; or <br />fig} Throws or drops any object or material from any parking <br />structure, bridge, viaduct, overpass, walkway or other elevated <br />structure. <br />~3} For purposes of this section "public place" means premises <br />which by function, custom, usage, notice or lack thereof, their physical <br />nature or other circumstances at the time, would cause a reasonable person <br />to believe that permission to enter or remain is not required. <br />Sectian 2. There is hereby added to the Eugene Cade, I971, a new sec <br />tion, to be numbered and provide: <br />4.774 Urinating o,r Defecating.
