~a} A statement of his/her findings that his/her failure to <br />act promptly wi 11 result i n serious prejudice to the public i nter~- <br />est or the interest of the parties concerned and the specific re a- <br />sons for his/her findings of prejudice; <br />fib} A citation of the legal authority relied upon and bear- <br />ing upon the promulgation of the rule; <br />~c} A statement of the need for the rule and a statement of <br />how the rule is intended to meet the need; and <br />~d} A list of the principal documents, reports, or studies, <br />if any, prepared by or relied upon by the city manager in consid- <br />ering the need for and in preparing the rule, and a statement of <br />the location at which those documents are available for public <br />inspection. <br />Any rule adopted, amended, or suspended under this section is temporary and <br />may be effective fora period of not longer than 18o days. The adoption of <br />a rule under this section does not preclude the subsequent adoption of an <br />identical rule under the permanent rule adoption procedures. <br />~5} Mailin List. Any person may request in writing that the <br />city manager mail him/her copies of notices of intended action given pur- <br />suant to ~1}~a}. Upon receipt of any request, the city manager shall ac k- <br />nowledge the request, establish a mailing list, and maintain a record of <br />all mailings made pursuant to requests. <br />Pets t~ on Request ._nq Ado ti <br />. ~ ~. i <br />6 _ ,, p on of Rule. Any interested person <br />may petition the Emergency ~~Med~ cal Services Board -~requesti ng the ~promul a- <br />g <br />tion, amendment, or repeal of a rule. The city manager may prescribe by <br />rule the form or contents of such petitions and the procedure for their sub- <br />mission, consideration, and disposition, Not later than 3o days after the <br />date of submission of a petition, the Emergency Medical Services Board shall <br />make a recommendation on the petition in writing to the city manager. <br />~7} Factual Basis far Rule. Unless otherwise provided by ordi- <br />nance, the adoption, amendment, or repeal of a rule by the city manager <br />need not be based upon or supported by an evidentiary record. <br />~8} I~alidity of Rules, All rules shall be adopted in substantial <br />compliance with the provisions of this section in effect on the date the <br />ru 1 e i s adapted . <br />3,131 Ambulance - License Re uirements. Each ambulance operator shall: <br />~a} Conform with the standards, requirements, and maintenance <br />provisions stated in the rules adopted by the State Health Division <br />and under section 3.127; <br />fib} Maintain and make available, upon request of the city <br />manager, all records required by rules made pursuant to section <br />3.127; <br />~c} Employ only emergency medical technicians who are certi- <br />fied by the State Health Division and who meet the requirements of <br />rules adopted under section 3.127. <br />~d} Enlist the services of a physician advisor who shall be <br />a resident of or actively practicing in the city; <br />fie} Make available, upon request, written information to the <br />public concerning rate information; <br />ordinance - 6 <br />
