~1} The city manager shall have the authority to approve rules and <br />to take action concerning licenses in accordance with the provisions of sec- <br />tions 3.115 to 3.145 of this code. <br />~2} The city manager shall adopt temporary rules that shall expire <br />184 days from the date of adoption. <br />~3} The city manager, or persons designated by the city manager in <br />writing, sha 11 have the authority to <br />~a} Convene the Emergency Medical Services Board; <br />fib} Administer oaths; <br />~c} Audit records to assure conformance with this chapter; <br />~d} Certify official acts; <br />fie} Subpoena and require attendance of witnesses at meetings <br />or hearings to determine compliance with sections 3.115 to 3.145; <br />~f} Require production of relevant documents; <br />fig} Swear witnesses; <br />~h} Take testimony of any person by deposition; and <br />(i} Perform all other acts necessary to enforce the pr~vi- <br />sions of sections 3.115 to 3,145 of this code. <br />3.129 Ambulance - Notice and Comment Procedure for Rulemakin . <br />~1} Notice of Rulemakin Prior to the adoption, amendment, ar <br />repeal of any rule, the city manager or designee shall give notice of in- <br />tended rulemaking by: <br />. ~a} Making copies of the notice of intended rul emaking <br />available to any person who has requested such notice; <br />fib} Publishing the notice of intended rulemaking in a news- <br />paper of general circulation. <br />~2} Contents of Natice, The notice of intended rulemaking shall <br />state the subject matter and purpose of the intended action in sufficient <br />detail to inform a person that the person`s interests may be affected, and <br />the time, place, and manner in which interested persons may present their <br />views on the intended action. This notice shall include: <br />~a} A citation of the legal authority relied upon and bear- <br />ing upon the promulgation of the rule; <br />fib} A statement of the need for the rule and a statement of <br />haw the rule is intended to meet the need; and <br />~c} A list of the principal documents, reports, or studies, <br />if any, prepared by or relied upon by the city manager in consid- <br />ering the need for and in preparing the rule, and a statement of <br />the location at which those documents are available for public <br />inspection, <br />~3} ~ ortunity for Comment, The city manager shall give inter- <br />ested persons reasonable opportunity to submit .data or views and shall con- <br />sider fully any written submissions. Opportunity for oral hearing shal 1 be <br />granted upon request, if such request is made within seven ~7} days after <br />the giving of notice of intended action. No additional notice of a hearing <br />to the general public shall be required. <br />~4} Emer envy Rules, Notwithstanding the above, the city manager <br />may adopt, amend, or suspend a rule without prior notice or hearing or upon <br />any abbreviated notice and hearing that he/she finds practicable, if the <br />city manager prepares: <br />Ordinance - 5 <br />
