<br />ADMINISTRATIVE ORDER <br />of the <br />City Manager of the City of Eugene, Oregon <br /> <br />The City Manager of the City of Eugene finds that: <br /> <br />A. The City of Eugene charges a per hour rate on city operated off- <br />street public parking facilities from 7:00 a.m. through 6:00 p.m., Monday <br />through Saturday. <br /> <br />B. It is common that vehicles enter the lot during the set hours of <br />operation and leave after the end of those hours of operation. <br /> <br />C. City of Eugene Municipal Code 5.285(1) states: <br /> <br />"A motor vehicle parked on or in a non-metered off-street parking <br />facility provided by the city may not be removed from that facili- <br />ty by a person other than a representative of the city authorized <br />so to remove it, until the charge for the parking, as indicated by <br />a city-authorized public notice at the facility, has been paid to <br />the city or to a representative of the city authorized to receive <br />the payment." <br /> <br />D. City of Eugene Municipal Code 5.990(3) states: <br /> <br />"Violation of Sections 5.285, 5.385, 5.565, 5.575, 5.580, and <br />5.585 shall be punishable by a fine not exceeding $25.00." <br /> <br />E. City has posted the hours of operation, the parking fee schedule, <br />and that it is a violation of Municipal Code 5.285 to leave the city off- <br />street public parking facilities without paying. <br /> <br />F. Attendants leave "PARKING FEE DUE" envelopes on vehicles in the <br />facility at the end of the day's hours of operations to provide a method for <br />the vehicle operator to pay the parking fee. Vehicle operators are requested <br />to place the amount owed in the Parking Fee Due Envelope and leave it at the <br />envelope drop box located on each lot. The vehicle operator is given the <br />option of mailing the fee envelope to the City of Eugene Finance Division. <br /> <br />G. The bail amount has not been set for violation of Municipal Code <br />5.285(1). <br /> <br />H. The City Manager has the authority to set the bail amount, through <br />an Administrative Order, within the limits set by the Municipal Code. <br /> <br />Page 1, Administrative Order <br />
