<br />of $100. Failure to submit two or more reports as required in paragraph 4 above during the <br />course of one license year shall result in City's not extending the license beyond the end of the <br />same year. <br /> <br />6. The rights, privileges and license granted shall be for a continuing five-year term <br />commencing the July 1 prior to license issuance, providing Licensee notifies City in writing by <br />June 1 of each year that Licensee elects to extend the license, and subject to the requirements of <br />this agreement and other federal, state and local requirements. <br /> <br />7. The annual license fee shall be assessed on the same basis as for all licensed Eugene <br />haulers as outlined in the City of Eugene Solid Waste and Recycling Collection Rule R-3.250 - <br />currently based on 5% of Licensee's gross receipts, less the tipping fee. Application and license <br />fees are not refundable. Failure of the Licensee to pay required application and license fees within <br />30 days notice of the amount thereof shall result in an automatic revocation of this license. <br /> <br />8. In addition to revocation under paragraph 7 above, this license may be revoked, <br />terminated or suspended upon failure of Licensee to secure and comply with any required permits <br />of any other governmental entity or failure to comply with any other term of this license, <br />including ongoing evidence of a minimum recovery of 40% for accounts collected within the <br />Eugene City limits for the period from 1995-99, and a minimum recovery of 60% for accounts <br />collected within the Eugene City limits for the year 2000. <br /> <br />9. Upon City's approval of any agreements therefore, Licensee may subcontract with <br />Sweet Home Sanitary Service to transport residual waste from Licensee's facility to a state <br />approved landfill or transfer station.
