<br />ADMINISTRATIVE ORDER NO. S 3 -q (g-/!;* <br />of the <br />City Manager Pro-Tem of the City of Eugene <br /> <br />Emergency Rule Amending Emergency Rule Concerning <br />Application of Hazardous Piping Regulations in Construction of <br />Semiconductor Manufacturing Facilities Adopted by Administrative <br />Order No. 53-96-03, and Extending the Effective Date. <br /> <br />The City Manager Pro-Tem of the City of Eugene finds that: <br /> <br />A. Pursuant to the authority of Sections 2.019(6) and Chapter 8 of the Eugene Code, <br />1971, which authorizes the City Manager to adopt rules for the administration and enforcement of <br />provisions of the Eugene Code, 1971, specifically including regulations and policies relating to <br />construction requirements, on March 14, 1996 I issued Administrative Order No. 53-96-03 adopting <br />Emergency Rule Concerning Application of Hazardous Piping Regulations in Construction of <br />Semiconductor Manufacturing Facilities. That Rule requires the application of the 1993 Oregon <br />Mechanical Specialty Code, Appendix 24 to the review of hazardous piping and equipment <br />installations in semiconductor manufacturing facilities during the processing of building permit <br />applications and conducting construction inspections. <br /> <br />B. That Emergency Rule, which will expire on September 10, 1996, should be extended <br />for an additional 180-day period, during which time the rule will be reviewed and considered for <br />adoption as a permanent rule, or a determination made to repeal the rule. <br /> <br />C. On April 1 , 1996 the 1996 Oregon Mechanical Specialty Code became effective and <br />the former Appendix 24 is now Appendix Chapter 14 of the 1996 Oregon Mechanical Specialty <br />Code. The Rule should therefore be amended to require the application of the 1996 Oregon <br />Mechanical Specialty Code, Appendix 14 to the review of hazardous piping and equipment <br />installations in semiconductor manufacturing facilities. <br /> <br />D. During the effective period of this emergency rule as extended, review and <br />consideration shall be given to the effect of this regulation, the resources required to provide this <br />regulation, and what final regulations should be included in a final rule or whether the rule should <br />be repealed. <br /> <br />E. I find that adoption of this emergency rule is necessary in order to ensure that this <br />policy is continued to be strictly adhered to by the Building Official in considering applications for <br />development or construction of semiconductor manufacturing facilities using hazardous piping and <br />equipment. <br /> <br />Administrative Order - 1 <br />
