<br />ADMINISTRATIVE ORDER NO. 53-98-13-F <br />of the <br />City Manager <br />City of Eugene <br /> <br />ESTABLISHING INCREASED OFF-STREET PARKING <br />FEES AND REPEALING ADMINISTRATIVE ORDER NO. 53-97-09-F. <br /> <br />The City Manager of the City of Eugene finds as follows: <br /> <br />A. Section 2.020 of the Eugene, Code, 1971 authorizes the City Manager to <br />determine and set fees and charges to be imposed by the City for services, goods, use of <br />municipal property, and licenses and permits. In addition thereto, Section 5.040 of that <br />Code specifically authorizes the City Manager to establish parking areas, time limitations, <br />form of permissible parking, and fees therefor, subject to the maximum charges for off- <br />street parking in Subsection 5.285(5) and on-street parking meter rates in Subsection <br />5.335(1 ). <br /> <br />B. In accordance with the procedures set forth therein, and after considering the <br />applicable criteria of Subsection 5.050(n)6. and Subsection 5.285(7) of the Eugene Code, <br />1971, on November 12, 1998 I issued Administrative Order No. 53-98-13 proposing an <br />increase in the City's off-street parking fees set forth in Section A.1. of the Parking Fee <br />Schedule and Regulations attached as Exhibit A to Administrative Order No. 53-97 -09-F, <br />effective January 1, 1999 as set forth in the Notice of Intended Fees attached as Exhibit <br />A thereto and incorporated therein by reference. <br /> <br />C. The Notice was provided to the Mayor and City Councilors, posted at two <br />locations at City Hall on November 12, 1998, and made available for inspection by <br />interested persons at the office of the City Manager, City Hall, 777 Pearl Street, Eugene, <br />Oregon, during normal business hours (8:00 a.m. to 5:00 p.m.. Monday through Friday, <br />exclusive of holidays). In addition thereto, copies of the notice were placed on vehicles in <br />the affected parking facilities on November 12, 1998. <br /> <br />D. The notice provided that interested persons could submit written comments <br />thereon for a period of 15 days from the date of posting. Four written comments were <br />received, to which I make the following findings: <br /> <br />Comment 1: Correspondence from Mary Sheriff indicates that she does not <br />object to the rate increase as proposed but wants to make the City aware of certain <br />problems associated with the Overpark. She reports that her car has been broken <br />into twice this year, the facility was full on one occasion when she returned to park <br />in the facility, and the monthly card reader was not functioning for several weeks. <br /> <br />Findings: Inasmuch as the comments do not relate to the proposed rate <br />increases, no findings are required herein, and staff will respond directly to the <br /> <br />Administrative Order - 1 <br />r:\adminord\fees\98offst2ao. wpd <br />
