<br />of Police may grant a variance as to the size of the sign, the <br /> <br /> <br />manner of erection, and the wording contained thereon, providing: <br /> <br /> <br />(1) The applicant demonstrates compliance would <br /> <br /> <br />create an unnecessary hardship in the particular in- <br /> <br /> <br />stance; <br /> <br /> <br />(2) Compliance is not feasible because of the <br /> <br /> <br />size, configuration, or other elements present on <br /> <br /> <br />the premises to be signed; and <br /> <br /> <br />(3) The requested variance would continue to <br /> <br /> <br />provide reasonable notice of the parking restrictions <br /> <br /> <br />to vehicle operators seeking a place to park. <br /> <br /> <br />B. The applicant shall submit with the application <br /> <br /> <br />a detailed statement of the variance requested and the reason(s) <br /> <br /> <br />therefor. <br /> <br />c. Upon receipt of the application, the Chief of <br /> <br /> <br />Police shall cause an inspection to be made of the premises <br /> <br /> <br />for which the variance is requested, and shall make a determina- <br /> <br /> <br />tion thereon within ten (10) days thereafter. The Chief of <br /> <br /> <br />Police may grant the variance as requested, or may condition <br /> <br /> <br />or modify the request, upon affirmative findings under subpara- <br /> <br /> <br />graph A above and that the signing is otherwise in compliance <br /> <br /> <br />with the purpose and intent of Section 5.540 of the Eugene Code, <br /> <br /> <br />1971 and other provisions of this Rule, or may deny the request. <br /> <br /> <br />D. The decision on the variance request shall be <br /> <br /> <br />in writing, shall state the reasons therefor, and shall be mailed <br /> <br /> <br />to the applicant at the address shown on the application.
