<br />decision of the Chief of Police is final. <br /> <br /> <br />3. Modification of Rules. <br /> <br /> <br />A. These Rules may not be modified except in an <br /> <br /> <br />emergency situation without the Chief of Police first giving <br /> <br /> <br />notice of the proposed modification by publication in a newspaper <br /> <br /> <br />of general circulation within the City and affording the public <br /> <br /> <br />an opportunity to comment thereon. The notice shall contain <br /> <br /> <br />a statement as to the proposed effective date of the modified <br /> <br /> <br />Rule, which shall be at least ten (l0) days after the date of <br /> <br /> <br />publication, advise that a copy may be obtained at the Police <br /> <br /> <br />Department upon payment of the fee normally charged for copies <br /> <br /> <br />of public records, and indicate the date of the public hearing <br /> <br /> <br />thereon. <br /> <br />B. At the time specified in the notice, the Chief <br /> <br /> <br />of police, upon finding the proposed modification to be consist- <br /> <br /> <br />ent wi th the purpose and intent of Section 5.540 of the Eugene <br /> <br /> <br />Code, 1971, shall adopt the Rule. <br /> <br /> <br />C. If the Chief of Police finds that an emergency <br /> <br /> <br />exists necessitating the immediate adoption of a modification <br /> <br /> <br />to these Rules, he may declare the modification a Temporary <br /> <br /> <br />Rule, immediately effective pending a hearing thereon as pro- <br /> <br /> <br />vided in A and B above. At the conclusion of the hearing, the <br /> <br /> <br />Temporary Rule may be declared a Permanent Rule by the Chief <br /> <br /> <br />of Police. <br /> <br /> <br />4. Compliance.
