!q~ ~1 <br />building shall exceed 25 feet in height. <br />fib} In the C-2, C-3 and C-4 districts there is no build- <br />ing height limitation, except when said districts abut upon a <br />residential district, in which case the maximum permitted building <br />height shall not exceed the maximum building height permitted in <br />the abutting residential district fora distance of 50 feet from <br />the abutting boundary. <br />~c} In the G0 district, no main building or accessory build- <br />ing shall exceed 25 feet in height within 50 feet of an abutting <br />AG, RA, R-I, or R-2 district. Dtherwi se, main and accessary bui ld- <br />ing height maximums shall be 45 feet unless: <br />1. The building`s height would obstruct solar radiation <br />to other main building rooftops in non-residential zoning <br />districts, or <br />2. The building`s height would obstruct existing or <br />potential solar radiation to south-facing building walls in <br />residential zoning districts. <br />As used in this section, "solar radiation" is the sunlight gener- <br />ated on December 2~ of any year between 10 a.m. and 3 p.m. stand- <br />and time. <br />~3} Industrial: <br />~a} In the I-~, I-2, and I-3 districts, no building height <br />shall obstruct solar radiation to: <br />I.. Other main building roof taps in industrial or <br />commercial zoning districts. <br />2. Potential main building roof tops 20 feet in height in <br />buildable areas in industrial or commercial zoning districts; <br />or, <br />3. Existing or potential south-facing building walls in <br />buildable areas in residential zoning districts. <br />As used in this section, "solar radiation" is the sunlight <br />generated on December 21 of any year between 10 a.m. and 3 p.m. <br />standard time, <br />~4} In the PL district, main and accessory buildings shall be a <br />maximum of 25 feet in height within 50 feet of AG, RA, R-1, and R-2 dis- <br />tricts, and 40 feet within 50 feet of R-3 districts. Also, the height <br />of buildings and additions constructed after September S, I982, shall not <br />obstruct solar radiation, on December 21 of any year from 10 a.m. to 3 p.m. <br />standard time, to south-facing residential building wails except for the <br />first five feet above the ground. If the area between the PL zoned parcel <br />and the adjacent residential structure averages at least a ID percent north- <br />faci ng slope, the parcel i s exempt from the solar radiation requirement. <br />Section 11. Subsections (1)(a) and (2)(a) of Section 9.540 of the <br />Eugene Code, ~97~, are hereby amended to read and provide: <br />9.54D Front Yards. See Figure ~0.} <br />~ ~} Residential <br />~a} Except for authorized cottage unit parcels and as other- <br />wise required in section 9.538.for garages and carports, all lots <br />ordinance - 16 <br />
