!q~ ~1 building shall exceed 25 feet in height. fib} In the C-2, C-3 and C-4 districts there is no build- ing height limitation, except when said districts abut upon a residential district, in which case the maximum permitted building height shall not exceed the maximum building height permitted in the abutting residential district fora distance of 50 feet from the abutting boundary. ~c} In the G0 district, no main building or accessory build- ing shall exceed 25 feet in height within 50 feet of an abutting AG, RA, R-I, or R-2 district. Dtherwi se, main and accessary bui ld- ing height maximums shall be 45 feet unless: 1. The building`s height would obstruct solar radiation to other main building rooftops in non-residential zoning districts, or 2. The building`s height would obstruct existing or potential solar radiation to south-facing building walls in residential zoning districts. As used in this section, "solar radiation" is the sunlight gener- ated on December 2~ of any year between 10 a.m. and 3 p.m. stand- and time. ~3} Industrial: ~a} In the I-~, I-2, and I-3 districts, no building height shall obstruct solar radiation to: I.. Also, the height of buildings and additions constructed after September S, I982, shall not obstruct solar radiation, on December 21 of any year from 10 a.m. to 3 p.m. standard time, to south-facing residential building wails except for the first five feet above the ground. If the area between the PL zoned parcel and the adjacent residential structure averages at least a ID percent north- faci ng slope, the parcel i s exempt from the solar radiation requirement. Section 11. Subsections (1)(a) and (2)(a) of Section 9.540 of the Eugene Code, ~97~, are hereby amended to read and provide: 9.54D Front Yards.
