ORDINANCE NO . ~ $ $ ~ ~ An ordinance initiating the vacation of the following described alley, to-wit: Beginning at the Northeast corner of Lot 1 of Overlook -~ Addition, as platted and recorded in Volume 4, Page 9, Lane County Oregon P~a,t Records, run thence North along the West line of Augusta Street, 12 feet, thence West parallel with the north line of overlook, l3~ feet, thence South l~ feet to the North line of Overlook, thence East 130 feet along the North line of Lot 1, Overlook, to the point of beginning in Eugene, Lane Y County, oregvn. RESERVING herein public utility and bicycle easements over, under, across and upon the entire above described tract, and the right to enter thereupon for .the purposes of ,construction reconstruction, repair and maintenance. ~Llndsey - AV 7~~-2~.. : THE CITY of EUGENE DQES ORDAIN ,AS F~I,LQWS - Section 1. The City Council of the City of Eugene herein ini- tiates the vacation proceedings on its own authority without peti- tion or consent of the property owners, except as provided by statute, of the above described alley. Section ~: A hearing shall be held upon the proposal to vacate the alley as herein provided, and the hearing shall be held on the 9th day of September, ~,981~, at noon Pacific Daylight Time of said date, at the Council Chambers at City Ha11, Eugene, Oregon, at which time all persons will be heard upon objections or suggestions with regard to the vacation, and at said time the Council will provide for the va,cation~. of the ~a~.ley or deny such vacation, and in case the vaca- tion is made, wi1.1 px.o~ride and make pro~rison for any damages sus- tained by local assessment.
