INSTT~UTTON 4F PRO- <br />CEEDINGS TN EMINENT DOMAIN FOR THE ACQUISITION <br />BY CONDEMNATION OF FEE STMPLE TTTLE, PERMANENT <br />AND TEMPORARY CONSTRUCTION EASEMENTS FOR THE <br />W2DENING OF ROOSEVELT BOULEVARD ~FR,4M WEST BELT- <br />LINE ROAD To MAPLE STREET; AND DECLARING AN <br />EMERGENCY. <br />The City Council of the City of Eugene finds that: <br />The City Council has authority under provisions of the City <br />Charter and applicable state law to institute proceedings in emi- <br />nent domain for the acquisition by condemnation of private property <br />for public purposes, including the widening and improvement of city <br />streets. <br />The City of Eugene is in the process of improving city streets <br />and widening intersections in order to facilitate the safe and effi~- <br />dent movement of traffic over the streets. Because the increased <br />volume of traffic using Roosevelt Boulevard in its present condition <br />creates a traffic hazard endangering persons and property, it is <br />necessary to improve the flow of tra~fis thereon, wh~.ch may be accom- <br />plished by widening the street. <br />The widening of Roose~relt Boule~rard from West Beltiine Road to <br />Maple Street necessitates the acquisition of fee simple title, per- <br />manent easements, and temporary construction easements to portions <br />of the parcels of real property described on the attached Exhibit <br />"A", which in the City"s judgment constitutes the most beneficial <br />and practical location for the improvements. <br />The proposed .improvements are in compliance with and in further- <br />once of the plans and specifications prepared by the City Engineer <br />Ordinance - 1 <br />
