l8$65 <br />at the Council's direction and in accordance with provisions of the <br />Eugene Code, 1971, and applicable policies and agreements of the City <br />of Eugene. Now, therefore, <br />THE CITY' OF EUGENE DOES ORD~.IN .AS FOLLOWS <br />Section 1. Based upon the above findings, the City Council of <br />the City of Eugene does hereby find, declare, and determine it neces- <br />sary to acquire fee simple title, permanent easements, and temporary <br />construction easements to portions of the real property more particu- <br />larly described an E~:hibit "~A", which is attached hereto and incor- <br />porated herein by reference, in order to widen Rovsevel~t Boulevard <br />from West Beltline Road to 1~aple street. That the above improvements <br />are in accordance with plans prepared by the City of Eugene Depart- <br />ment of Public Works and approved by the City tanager, <br />Section 2. The City Council does hereby direct that the City <br />of Eugene shall institute proceedings in eminent domain for the con- <br />demnation of the above described interests i,n real property, and, at <br />least 2 0 days prior to th.e filing of any action for condemnation to <br />make a written offer to the owners or parties having an interest <br />therein of a stated amount as compensation thexefar and for any com- <br />pensable damages to remaining property, <br />Section 3, The Ca.ty Council hereby declares that the improve-- <br />ments above set foxth are for a public puxpose, are necessary far <br />the public welfare, and are authorized under the laws of the State <br />of Oregon and Charter and ordinances o~ th.e City of Eugene, <br />Secti~ri ~. The City Council fuxther declares that the inter- <br />ests in real property described on E.~hibit "~" hereto and incorpor- <br />Ordinance ~- 2 <br />
