ORD INANCr~ No . ~~ <br />An ordinance vacating the following described street, and <br />declaring an emergency, to-wit: <br />As described on Exhibit "A" attached hereto and <br />incorporated herein by reference . ~.Ci ty of <br />Eugene - Performing Arts Center/Convention Center <br />Sv 81-1} <br />The City Council of the City of Eugene finds that: <br />1. On the 29th day of April, 1981, the City Council of the <br />City of Eugene passed ordinance No. 18780 setting a hearing to be <br />held on the Sth day of June, 1951, at the Council Chambers at City <br />Hall, Eugene, Oregon, at which time and place protests and remon- <br />strances could be heard as to the proposed vacation of the above <br />described street. <br />2. Notice was duly and regularly given of the hearing and <br />a hearing was held pursuant to the ordinance at the Council <br />Chambers, at City Hall, Eugene, Oregon, on the 8th day of June, <br />1981, at 7:30 p.m., Pacific Daylight Time, and at said time and <br />place the Council heard all objections. <br />3. Remonstrances were filed by several of the owners of <br />affected real property as defined in oRS 271.080, However, the <br />objecting owners fail to comprise ownership of the majority of <br />the area affected under oRS 27,.130. Because of this, and be- <br />cause the owners of abutting property to the vacated area have <br />consented to the vacation and applied for the same, and in light <br />of these findings, such remonstrances are denied. <br />4. In order to evaluate the merits of such remonstrances, <br />the City staff at the June S, 1981 Council meting was directed <br />to return to the Council at a future date with a recommended <br />course of action. <br />5. on July Sr 1981, the City Council again considered the <br />matter and directed the formation of a special task team to re- <br />turn with a recommended course of action. <br />6. On December 7, 1981, the Council reviewed the recommen- <br />dation of this special task team and after consideration of that <br />report and additional public testimony on the task team report, <br />determined that the vacation of the street as described in Exhibit <br />"A" hereto is in the public's interest and that the public inter- <br />est will not be prejudiced by this street vacation. <br />ordinance - 1 <br />
